Ordinance No. 1,234ORDINANCE NO. 1234 AN ORDINANCE AMENDING CHAPTER 24, PLUMBING, OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF SECTION 12.1.4, MATERIALS & USES, "SUGGESTED PLUMBING CODE...PREPARED BY THE TEXAS MUNICIPAL LEAGUE AND DISTRIBUTED IN THE MONTH OF JULY, 1971 ", INCOR- PORATED BY REFERENCE IN ORDINANCE NO. 1117 OF THE CITY OF BAYTOWN, BY THE ADDITION OF LIMESTONE AGGREGATE CONCRETE SEWER. PIPE WITH RUBBER GASKET, BUILDING SEWER OUTSIDE, PROVIDING A REPEALING CLAUSE, CONTAINING A SAVINGS CLAUSE, PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: Chapter 24 of the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Section 12.1.4, Materials and Uses, "Sug- gested Plumbing Code... prepared by the Texas Municipal League and distributed in the month of July, 1971 ", incorporated by reference in Ordinance No. 1117, introduced, read and passed by the affirmative vote of the City Council of the City of Baytown on the 17th day of August, 1971, by the addition Limestone Ag- gregate Concrete Sewer Pipe with Rubber Gasket, Building Sewer Outside. This ordinance is to supplement Ordinance No. 1117 which constitutes Chapter 24 of the Baytown Code of Ordinances and should hereafter be incorporated within Chapter 24 of the Code of Ordinances of the City of Baytown and be num- bered appropriately. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision of this Code, or the application thereof to any person or circumstances, is held invalid, the re- mainder of the Code, and the applicaton of such provision to other persons or circumstances, shall not be effected thereby. Section 4: Penalty Clause: Any person, either by himself or agent, and any firm, corporation or other entity who violates any of the provisions of this Code shall be deemed guilty of a misdemeanor and, upon conviction of any such violation, shall be fined in any sum not to exceed ONE HUNDRED DOLLARS ($100.00); and each day during, which such violation continues shall constitute a separate and distinct offense. In any case of a violation of any of the terms or provisions of this ordinance by any corporation, the officers and agents actively in charge of the business of such corporation shall be subject to the penalty herein provided. Any offense defined herein which has been defined by laws of the State of Texas as an offense and for which penalty has been pre- scribed shall be punished as provided in said State Law, and nothing herein shall be held as fixing any penalty contrary to a penalty provided by the laws of the State of Texas. Section 5: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing this ordinance to be published in its entirety in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
