Ordinance No. 1,228ORDINANCE NO. 1228 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A CONTRACT WITH T.V. PIPE INSPECTION COMPANY FOR THE REPAIR OF A SEWER LINE AND AU- THORING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF FIVE THOUSAND FOUR HUNDRED THREE AND 50/100 ($5,403.50) DOLLARS WITH REGARD TO SUCH AGREEMENT, AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, 450 feet of sewer line extending from Midway Street to Bob Smith Road is in a present state of disrepair due to pipe deterioration and resulting cave -ins; and WHEREAS, due to the above mentioned deterioration, it is comtemplated that the number of failures in said line will increase, and in the very near future, this sewer line will be rendered completely unuseable; and WHEREAS, said sewer line serves a large area and a great number of people; and WHEREAS, considering the above City Council of the City of Baytown deems that an emergency situation exists. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That the Mayor and City Clerk of the City of Baytown are hereby authorized and directed to enter into a contract containing the usual performance and payment bond provision with T.V. Pipe Inspection Company for the repair of 450 feet of sewer line extending from Midway Street to Bob Smith Road, and authorizes the contracting of indebtedness by the City for the sum of Five Thousand Four Hundred Three and 50/100 ($5,403.50) Dollars with regard to such agreement. Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown, Texas.
