Ordinance No. 1,227ORDINANCE NO. 1227 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF SOUTHERN STEEL COMPANY OF SAN ANTONIO, CONDITIONED UPON SOUTHERN STEEL COMPANY OF SAN ANTONIO'S AGREEING TO ACCEPT AS PAYMENT UNDER THE CONTRACT, CERTIFICATES OF OBLIGATION OF THE CITY OF BAYTOWN, SUBJECT TO A TAKE -OUT LETTER BY A BANK OR OTHER FINANCIAL INSTITUTION OR CASH, AT THE CITY'S OPTION, TO FUR- NISH AND INSTALL JAIL EQUIPMENT IN THE CONSTRUCTION OF A MUNICIPAL FACILITY FOR BAYTOWN, TEXAS, (POLICE BUILDING), JOB NO. 71 -511, AS PART OF THE CAPITAL IMPROVEMENTS PROGRAM, AND AUTHORIZING THE CON- TRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF SIXTY -FOUR THOUSAND AND NO /100 ($64,000.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize A. J. Busch, Consulting Engineer for the City of Baytown, to advertise for bids for the construction of a Municipal Facility for Baytown (Police Building) to be received April 26, 1972; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 1:00 o'clock p.m., Wednesday, April 26, 1972, as per the published notice to bidders. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby accepts the bid of Southern Steel Company of San Antonio, conditioned upon Southern Steel Company of San Antonio's agreeing to accept as payment under the contract, Certificates of Obligation of the City of Baytown, Texas, subject to a take -out letter from a bank or other financial institution or cash, at the City's option, to furnish and install jail equipment in the construction of a Municipal Facility for Baytown (Police Building), Job No. 71 -511, according to the plans and specifications set forth by the City Engineer on a construction timetable at 240 days for the sum of Sixty -Four Thousand and No /100 ($64,000.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized to execute and attest to a contract with Southern Steel Company of San Antonio to furnish and install jail equipment in the construction of said Municipal Facility (Police Building) containing the plans, specifications and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes Article 5160. INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown this 23rd day of May , 1972.
