Ordinance No. 1,2164W ORDINANCE NO. 1216 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING APPENDIX B OF THE CODE OF ORDINANCES, ENGINEERING AND CONSTRUCTION STANDARDS FOR SUBDIVISIONS, STREET LIGHTS, SUB- SECTION (D); TO REPEAL THE PROVISIONS OF SUCH SUBSECTION AS PRESENTLY CONSTITUTED AND TO SUBMIT IN ITS PLACE A NEW SUB - SECTION(D) WHICH WOULD PROVIDE FOR A CASH PAYMENT OR FOR POSTING OF SECURITY AS PROVIDED IN SECTION 27- 20(H)(2); RE- PEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Appendix B, Engineering and Construction Standards for Subdivisions, Street Lights, by repealing Subsection(d) thereof and the same shall cease to have force and effect from and after the effective date of this ordinance. Section 2: That the Code of Ordinances is hereby amended by adding thereto a new Subsection (d) of Appendix B, Engineering Construction Standards for Subdivisions, Street Lights, which shall read as follows, to -wit: Street lights. (d) A cash payment or posting of security as provided in Section 27- 20(h)(2) in the amount of One Hundred Fifty and No /100 ($150.00) Dollars per ornamental street light standard guaranteeing cash payment within one year of final approval of the plat, unless a different time shall be designated by the Planning Commission at the time of final approval of the plat, shall be required before building permits will be issued in a new subdivision within the city limits. The payment of said sum shall constitute a final and one time payment by the developer to the city and represents the cost of a standard 3300 Lumen metal pole street light at Thirty and No /100 ($30.00) Dollars per year for five (5) years. Section 3: Repealing Clause: All ordinances or parts of ordi- nances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
