AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 12, FIRE PRE-
VENTION AND PROTECTION, ARTICLE IV, SECTION 12.47.1, DENSITY
STANDARDS FOR RESIDENTIAL DEVELOPMENT; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING
FOR AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of Baytown, Texas,
is hereby amended by the amendment of Chapter 12, Fire Prevention and Protection,
Article IV, Section 12.47.1, Density Standards for Residential Development so as
to repeal the provisions of Section 12.47.1 as presently constituted and to sub-
stitute in its place a new section, to -wit:
Section 12 -47.1 Site Standards.
(a) Residential development designed for rental occupancy shall not
exceed twenty (20) dwelling units per parcel acre except that:
(1) In computing the developers parcel acreage credit may be
given for up to one -half of any abutting permanent open
space as determined by the Planning Commission.
(2) In no case shall open space be utilized to permit den -
sities in excess of one hundred and fifty percent (150 %)
of those otherwise permitted.
(b) On -site parking shall be provided for residential development
designated for rental occupancy at the rate of two and one -
quarter spaces per dwelling unit. Geometric design standards
for driveways and parking spaces set forth in Appendix C to
this Code of Ordinances.
Section 2: Repealing Clause: All ordinances or parts of ordi-
nances inconsistent with the terms of this ordinance are hereby repealed;
provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative
of other ordinances regulating and governing the subject matter covered
by this ordinance.
Section 3: Savings Clause: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances, shall for any
reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or
their application to other persons or sets of circumstances and to this
end all provisions of this ordinance are declared to be severable.
Section 4: Effective Date: This ordinance shall take effect
from and after its passage by the City Council of the City of Baytown.
