Ordinance No. 1,202M ORDINANCE NO. 1202 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS BY THE AMENDMENT OF CHAPTER 12, FIRE PRE- VENTION AND PROTECTION, SECTION 45, DEFINITIONS, BY THE ADDITION OF SUBSECTION F; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR AN EF- FECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by the amendment of Chapter 12, Fire Prevention and Protection, Section 45, Definitions, by the addition of Subsection (f) thereto, to -wit: Section 12 -45. Definitions. (f) Permanent open space. A "permanent open space" is an open space which, in the judgment of the Planning Commission, may be expected to remain open and undeveloped. Examples of permanent open space would be existing public parks or flood control drainage easements. Land in private ownership or public street right -of -way does not constitute permanent open space. Section 2: Repealing Clause: All ordinances or parts of ordi- nances inconsistent with the terms of this o provided, however, that such repeal shall be inconsistency and in all other respects this of other ordinances regulating and governing by this ordinance. Section 3: Savings Clause: If any rdinance are hereby repealed; only to the extent of such ordinance shall be cumulative the subject matter covered provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
