AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, SECTION 4 -17, ANNUAL
FEE; TO REPEAL THE PROVISIONS OF SUCH SECTION AS PRESENTLY CON-
STITUTED AND TO SUBMIT IN ITS PLACE A NEW SECTION 4 -17; REPEALING
ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE,
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section l: That the Code of Ordinance of the City of Baytown is
hereby amended by the amendment of Chapter 4, Alcoholic Beverages, by re-
pealing Section 4 -17, Annual Fee, thereof and the same shall cease to have
force and effect from and after the effective date of this ordinance.
Section 2: That the Code of Ordinances is hereby amended by adding
thereto a new Section 4 -17, Annual Fee, which shall read as follows, to -wit:
Sec. 4 -17. Annual Fee.
(a) The fee required to be paid by Section 4 -16 shall be the
maximum fee permitted to be levied and collected by a city or town
pursuant to the provisions of Article 666 -15al VAPC.
(b) These fees shall be payable on the initial application for
a license and each year thereafter on the anniversary of the is-
suance of that license.
Section 3: Repealing Clause: All ordinances or parts of ordi-
nances inconsistent with the terms of this ordinance are hereby repealed;
provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative
of other ordinances regulating and governing the subject matter covered
by this ordinance.
Section 4: Savings Clause: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances, shall for any
reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or
their application to other persons or sets of circumstances and to this
end all provisions of this ordinance are declared to be severable.
Section 5: Effective Date: This ordinance shall take effect
from and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 21st day of March
