AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
DECLARING THAT AN EMERGENCY SITUATION EXISTS AUTHORIZING THE
MAYOR AND THE CITY CLERK TO EXECUTE A CONTRACT WITH NAYLOR
PIPE CLEANING COMPANY FOR THE REPAIR OF SEWER LINES AND AU-
THORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE
SUM OF NINE THOUSAND THREE HUNDRED FIFTY -FOUR DOLLARS AND 82/100
($9,354.82) DOLLARS WITH REGARD TO SUCH AGREEMENT, AND PROVIDING
FOR AN EFFECTIVE DATE HEREOF.
WHEREAS, 170 feet of sewer line extending south on Dorris Street from the
intersection of Dorris Street and Monterey Street, 944 feet of sewer line on
Airhart Drive from Myer Street to Park Street, and 340 feet of sewer line from
Yupon Street to the Pointe Royale Lift Station are in a present state of dis-
repair due to pipe deterioration and resulting cave -ins; and
WHEREAS, due to the above mentioned deterioration, it is contemplated
that the number of failures in said line will increase, and in the very near
future, these sewer lines will be rendered completely unuseable; and
WHEREAS, said sewer lines serve a large area and a great number of people;
and
WHEREAS, considering the above City Council of the City of Baytown deems
that an emergency situation exists.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section l: That the City Council of the City of Baytown, Texas, hereby
declares. that an emergency situation exists.
Section 2: That the Mayor and City Clerk of the City of Baytown are
hereby authorized and directed to enter into a contract containing the usual
performance and payment bond provision with Naylor Pipe Cleaning Company for
the repair of 170 feet of sewer line extending south on Dorris Street from the
intersection of Dorris Street and Monterey Street, 944 feet of sewer line on
Airhart Drive from Myer Street to Park Street, and 340 feet of sewer line from
Yupon Street to the Pointe Royale Life Station, and authorizes the contracting
of indebtedness by the City for the sum of Nine Thousand Three Hundred Fifty -
Four and 82/100 ($9,354.82) Dollars with regard to such agreement.
Section 3: This ordinance shall take effect from and after its passage
by the City Council of the City of Baytown, Texas.
