AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ACCEPTING THE PROPOSAL OF SOUTHERN PACIFIC TRANSPORTATION COMPANY
TO INSTALL AND BEAR SEVENTY -FIVE (75%) PERCENT OF THE COST OF THE
CONSTRUCTION OF AUTOMATIC GATES AT CERTAIN RAILROAD CROSSINGS WITH-
IN THE CITY OF BAYTOWN; AUTHORIZING THE MAYOR AND CITY CLERK TO
ENTER INTO A CONTRACT FOR SUCH PURPOSE, IF NECESSARY AND PROVIDING
FOR AN EFFECTIVE DATE HEREOF.
WHEREAS, there presently exist in the City of Baytown many dangerous
railroad crossings which require protection for vehicular traffic; and
WHEREAS, in order to insure that these crossings will be properly
signalized the City Council of the City of Baytown is willing for the City
of Baytown to bear a portion of the expense of signalization of certain
more hazardous crossings; and
WHEREAS, the cost of a completely installed automatic gate at each
intersection will be Sixteen Thousand One Hundred Sixty and No /100 ($16,160.00)
Dollars; and
WHEREAS, Southern Pacific Railroad has indicated that automatic gates
can be installed at three (3) specified intersections on or before September
1, 1972.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That the City Council hereby formally accepts the proposal
of Southern Pacific Railroad to install automatic gates, prior to September
1, 1972 at the railroad crossings, at MASSEY TOMPKINS ROAD, BOB SMITH ROAD,
and CEDAR,BAYOU ROAD and to bear seventy -five (75 %) percent of the cost
of installation thereof.
Section 2: That the City of Baytown will pay to Southern Pacific
Transportation Company twenty -five (25 %) percent of the total installation
cost of Sixteen Thousand One Hundred Sixty and No /100 ($16,160.00) Dollars
per crossing, that being the sum of Four Thousand Forty and No /100 ($4,040.00)
Dollars per crossing, on the total sum of Twelve Thousand One Hundred Twenty
and No /100 ($I2,120.00) Dollars for the three (3) crossings upon completion
of installation of automatic gates at all three (3) crossings.
Section 3: That the Mayor is hereby authorized and directed to execute
and the City Clerk to attest to a contract with Southern Pacific Transportation
Company, if necessary.
Section 4: This ordinance shall take effect from and after its passage by
the City Council.
