Ordinance No. 1,172r ORDINANCE NO. 1172 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ABANDONING THE 5' BY 50' UTILITY EASEMENT EXTENDING FROM THE REAR ALONG THE CENTER LINE OF LOTS 7, 8, 9, AND 10, BLOCK NO. 11, MARTIN ADDITION, BAYTOWN, HARRIS COUNTY, TEXAS, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS ARE NECESSARY FOR SUCH ABANDONMENT, IF ANY; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, there presently exist a 5' by 50' utility easement extending from the rear along the center line of Lots 7, 8, 9, and 10, Block No. 11, Martin Addition, Baytown, Harris County, Texas; and WHEREAS, this easement was taken in order that utilities could be provided to Lots 7, 8, 9, and 10 are presently owned by the same individual and may be served in another manner; and WHEREAS, the owner of said property is willing to bear the expense of any changes required by the Public Works Department, and after said changes are made there will be no need for such utility easement. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the 5' by 50' utility easement extending from the rear along the center line of Lots 7, 8, 9, and 10, Block 11, Martin Addition, Baytown, Harris County, Texas, be and is hereby abandoned and the Mayor and City Clerk are hereby authorized to execute such instruments as are necessary for such abandonment, if any. Section 2: This Ordinance is to become effective from and after its date of passage.
