AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO
A REIMBURSEMENT CONTRACT IN THE AMOUNT OF ONE THOUSAND
THREE HUNDRED SIX AND 98/100($1,306.98) DOLLARS WITH
FRIENDSWOOD DEVELOPMENT COMPANY FOR CERTAIN WATER SYSTEM
IMPROVEMENTS IN THE ROLLINGBROOK SUBDIVISION PURSUANT TO
SECTION 27 -56 OF THE CODE OF ORDINANCES OF THE CITY OF
BAYTOWN AND PROVIDING FOR AN EFFECTIVE DATE HEREOF.
WHEREAS, Friendswood Development Company has planned the installation
of an eight (8) inch waterline in the Rollingbrook Subdivision in Baytown,
Texas; and
WHEREAS, the City of Baytown has required that the abovementioned water-
line be increased twelve (12) inches to provide a future loop; and
WHEREAS, Section 27 -56 of the Code of Ordinances of the City of Baytown,
provides that the cost of utilties and or streets which are required by the
City to be larger than would normally be needed to serve the proposed addition
will be partially reimbursed and that the reimbursable amount would be the
difference between the cost of these facilities that would be adequate to
serve the addition, and the cost of the facilities required by the city; and
further, that a reimbursement contract will be negotiated between the City Council
and the developer; and
WHEREAS, the total cost of the twelve (12) inch waterline is Three Thousand
Thirty and 26/100 ($3,030.26) and the total cost of the eight (8) inch waterline
originally proposed by Friendswood Development Company is One Thousand Seven
Hundred Twenty -Three and 28/100 ($1,723.28) with the resulting additional cost
for the twelve (12) inch waterline being One Thousand Three Hundred Six and 98/100
($1,306.98) Dollars; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That pursuant to Section 27 -56 of the Code of Ordinances of
the City of Baytown, the Mayor and City Clerk of the City of Baytown are hereby
authorized and directed to enter into a reimbursement contract with Friendswood
Development Company in the amount of One Thousand Three Hundred Six and 98/100
($1,306.98) Dollars for certain water system improvements in the Rollingbrook
Subdivision in the City of Baytown, Texas, conditioned upon approval and ac-
ceptance of the construction of said waterline by the City Engineer of the
City of Baytown.
Section 2: This ordinance shall take effect from and after its passage
by the .City Council of the City of Baytown.
