ORDINANCE NO. 1158
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING PAYMENT OF TERMINATION BENEFITS TO D. R. VOELKEL
WHOSE RESIGNATION WAS ACCEPTED BY THE CITY COUNCIL OF THE CITY
OF BAYTOWN ON THE 17TH DAY OF JANUARY, 1972 AND PROVIDING FOR
AN EFFECTIVE DATE THEREOF.
WHEREAS, the services of D. R. Voelkel as City Manager of the City of
Baytown, Texas, were terminated as of the 17th day of January, 1972, upon ac-
ceptance of his resignation by the City Council; and
WHEREAS, the personel policies of the City of Baytown as approved by
the City Council of the City of Baytown, Texas, by Ordinance No. 966, provide
the following:
3.03 Sick leave with pay. (Symbol "S ")
2(b) Terminal pay will be authorized for unused sick leave for
terminating employees up to 90 days. However, any employee
who terminates with the City and who is authorized payment
for unused sick leave, will not be rehired for City em-
ployment, unless or until said employee reimburses the
City the payment received for unused sick leave.
3.04 Vacation. (Payroll Symbol "V ")
(a) Conditioned upon completion of one year of service; employees
in permanent positions will be eligible for vacation benefits,
either as time off with pay or as terminal pay in cases of
separation from City employment.
(g) Upon termination employees will be paid for earned vacation
time up to a maximum of 30 working days; and
WHEREAS, the said, D. R. Voelkel, had accumulated and unused at the
time of the termination of his employment the following benefits:
Sick Leave 38 3/4 days
Vacation benefits 21 1/4 days
WHEREAS, the perdiam rate based upon this salary of the said D. R.
Voelkel is Seventy and Ninety -Five and Four /Tenths ($70.95 4/10) Dollars; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the payment of termination benefits for a period of
sixty (60) days at the rate of Seventy and Ninety -Five and Four /Tenths($70.95)
Dollars perdiam or the total sum of Four Thousand Two Hundred Fifty -Seven and
24/100 ($4,257.24) Dollars to D. R. Voelkel is hereby authorized and directed.
Section 2: This Ordinance shall take effect from and after its passage
by the City Council of the City of Baytown, Texas.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council
of the City of Baytown, Texas, on the 24th day of January 1972.
