Ordinance No. 1,154ORDINANCE NO. 1154 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY AMENDMENT OF CHAPTER 18, MOTOR VEHICLES AND TRAFFIC, BY AMENDING SECTION 18 -122.1 THEREOF SO AS TO REPEAL THE PROVISIONS OF SUCH SECITON AS PRESENTLY CONSTITUTED AND TO SUBSTITUTE IN ITS PLACE THE PROVISIONS OF A NEW SECTION SETTING OUT THE AREAS STREETS OR PORTIONS OF STREETS LYING WITHIN THE CORPORATE LIMITS OF THE CITY OF BAYTOWN, WHICH CONSTITUTE TWO (2) HOUR TIME LIMIT PARKING ZONES AS COMTEMPLATED BY SECTION 18 -122.1 OF THE BAYTOWN CODE OF ORDINANCES; PROVIDING FOR PENALTIES; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 18, Motor Vehicles and Traffic, by re- pealing Section 18 -122.1 thereof, and the same to cease to have force and effect from and after the effective date of this ordinance. Section 2: That the Code of Ordinances, herein is hereby amended by adding thereto a new Section 18- 122.1, Designation of two -hour parking limit zones, in Chapter 18, Motor Vehicles and Traffic, which shall read as follows, to -wi t: Section 18- 122.1. Designation of two -hour parking limit zones. Texas Avenue from Whiting Street to First Street. Pearce Street from Whiting Street to Commerce Street. Defee Street from Pruett Street to Commerce Street, except for the first three parking places on the north side of Defee Street east of the intersection of Defee Street and Gaillard Street. Commerce Street from Pearce Street to Defee Street. Ashbel Street from Pearce Street to Defee Street. Gaillard Street from Pearce Street to Defee Street, except for the first seven (7) parking places on the ease side of Gaillard Street and Defee Street. Jones Street from Pearce Street to Defee Street. Main Street from Pearce Street to Defee Street. The time limits pertaining to the above described time -limit parking zones shall apply every day between the hours of eight (8) o'clock a.m. and six (6) o'clock p.m., except Sundays and legal holidays observed by the City. It shall be unlawful and a violation of the provisions of this or- dinance for any person; (a) to permit any vehicle registered in the name of or operated by such person to be parked beyond the period of legal parking es- tablished in any of the designated time -limit parking zones, (b) to park any vehicle across any line or marking of a time -limit parking zone so as not to be entirely within the area designated by such lines or markings, (c) To deface or remove or otherwise tamper with any sign or marking designating an area as a time - parking zone. Any person, firm or corporation who shall violate any of the provisions of this section pertaining to the over -time parking shall be deemed guilty of an offense and shall be punished by a fine of four dollars ($4.00). If the fine is paid in the Municipal Court on or before ten (10) days from the date of the ticket, a Two Dollar ($2.00) discount shall be allowed. If the fine is not paid after the expiration of ten (10) days from the date of the ticket, a capias may be issued, and the violator may be required to post a bond of up to Two Hundred Dollars ($200.00). Section 3: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: Savings Clause: If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinances shall take effect from and after ten (10) days from its adoption by the City Council of the City of Baytown, Texas. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten days after its passage. -2- INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown, on this 18th day of January 1972.
