Ordinance No. 1,136ORDINANCE NO. 1136 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF APPENDIX B THERETO, ENGINEERING AND CONSTRUCTION STANDARDS FOR SUBDIVISIONS, BY REVISING SECTION (a) (2) OF THE SECITON ENTITLED WATER AND SEWER SYSTEM; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by the amendment of Appendix B, Engineering and Construction Standards for Subdivisions, Section (a) (2) of the Section entitled Water and Sewer System so as to repeal the provisions of such Appendix and Subsection as presently considered and to substitute in its place a new provision; to -wit: APPENDIX B ENGINEERING AND CONSTRUCTION STANDARDS FOR SUBDIVISIONS Water and Sewer System. (a) Sewer lines. (2) Materials. Sanitary sewer lines may be of the following materials: (i) VITRIFIED CLAY PIPE and fittings conforming to the latest revision of ASTM C- 261 -60T, Class II (Standard Strength) with extra strength where required. (ii) CONCRETE PIPE conforming to the latest revision of ASTM C -14 (unreinforced) and ASTM C -76 (reinforced) witth the compression type rubber gasket joints complying with the latest revision of ASTM C -443 or C -361, having aggregate composed of not less than 75% crushed limestone or dolemite, and wall thickness of 1 1/8" for 8" diameter, 1 3/8" for 10" diameter and conforming to ASTM C -76 for 12" and larger diameters. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordi- nance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
