Ordinance No. 1,135ORDINANCE NO. 1135 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 5, ANIMALS, BY AMENDING SECTION 5-9 THEREOF; REPEALING ORDINANCES INCON- SISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 5, Animals, by amendment of Section 5-9 thereof, which shall read as follows, to -wit: Section 5-9. Rabies protection - Procedure when animal bites or scratches person. 1. It shall be the duty of any person owning or having charge of any warm blooded animal which may have bitten, clawed or scratched any person, to make a report of such incident to the City Humane Department. All incidents so reported, or otherwise coming to the attention of the Humane Department shall cause the animal to be confined in a manner and for such a period prescribed by the City Health Officer. No dog held for observation shall be released from confinement without the authorization of the city health officer. 2. If the animal is not currently immunized against rabies by means of anti -rabies vaccine, the owner of such animal shall be re- sponsible for all expenses incurred by such confinement, whether at the City Pound or a veterinary hospital. If the animal is currently immunized against rabies by means of anit-rabies vaccine and the person who was bitten, clawed or scratched was inside a closed and locked enclosure provided for the animal by its owner without the owner's consent, the expenses of confinement shall be borne by the person bitten, clawed or scrathced; or his parent, guardian or custodian. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Effective Date: This ordinance shall take effect from and after its passage by the City Council.
