Ordinance No. 1,124ORDINANCE NO. 1124 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ABANDONING THE 4' BY 50' UTILITY EASEMENT EXTENDING FROM THE REAR ALONG THE CENTER LINE OF LOTS 27 AND 28, BLOCK NO. 1, MORRELL PARK SUBDIVISION, SECTION 2, AS RECORDED IN VOLUME 20 AT PAGE 49 OF THE MAP RECORDS OF HARRIS COUNTY, TEXAS; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS ARE NECESSARY FOR SUCH ABANDONMENT, IF ANY; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, there presently exist a 4' by 50' utility easement extending from the rear along the center line of Lots 27 and 28, Block No. 1, Morrell Park Subdivision, Section 2, as recorded in Volume 20 at Page 49 of the Map Records of Harris County, Texas; and WHEREAS, this easement was originally platted in order that utilities could be provided to Lots 27 and 28, Block 1 of said subdivision; and WHEREAS, said Lots 27 and 28 are presently being served by a utility easement which runs along the rear of said lots and there is not now nor has there ever been a need for such utility easement. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the 4' by 50' utility easement ex- tending from the rear along the center line of Lots 27 and 28, Block No. 1, Morrell Park Subdivision, Section 2, as recorded in Volume 20 at Page 49 of the Map Records of Harris County, Texas, be and is hereby abandoned and the Mayor and City Clerk are hereby authorized to execute such instruments as are necessary for such abandonment, if any. Section 2: This Ordinance is to become effective from and after its date of passage.
