AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
DECLARING THAT AN EMERGENCY SITUATION EXISTS AUTHORIZING THE
MAYOR AND THE CITY CLERK TO EXECUTE A CONTRACT WITH NAYLOR
SUPPLY COMPANY FOR THE REPAIR OF APPROXIMATELY TWO HUNDRED
SEVENTY -FIVE FEET OF SEWER LINE AT A COST OF FIVE DOLLARS
AND 75/100 ($5.75) PER FOOT AND AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS BY THE CITY FOR THE SUM OF APPROXIMATELY
ONE THOUSAND FIVE HUNDRED EIGHTY -ONE AND 25/100 ($1,5$1.25)
DOLLARS WITH REGARD TO SUCH AGREEMENT, AND PROVIDING FOR AN
EFFECTIVE DATE HEREOF.
WHEREAS, the sewer line connecting the easement between
Inwood Drive and Pamela Drive and the easement between Pamela
Drive and Harold Lane is in a present state of disrepair due to
pipe deterioration and resulting cave -ins; and
WHEREAS, due to the above mentioned deterioration, it is
contemplated that the number of failures in said line will in-
crease, and in the very near future, the entire sewer line will
be rendered completely unuseable; and
WHEREAS, said sewer line serves a large area and a great
number of people; and
WHEREAS, considering the above City Council of the City of
Baytown deems that an emergency situation exists.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section l: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That the Mayor and City Clerk of the City of
Baytown are hereby authorized and directed to enter into a con-
tract, containing the usual performance and payment bond provision,
with Naylor Supply Company for the repair of the sewer line
connecting the easement between Inwood Drive and Pamela Drive and
the easement between Pamela Drive and Harold Lane, and authorizing
the contracting of indebtedness by the City for the sum of ap-
proximately ONE THOUSAND FIVE HUNDRED EIGHTY -ONE AND 25/100
($1,581.25) Dollars, or for approximately two hundred seventy -five
feet at a cost of FIVE DOLLARS AND 75/100 ($5.75) per foot of
polyethelene pipe with regard to such agreement.
Section 3: This ordinance shall take effect from and after
its passage by the City Council of the City of Baytown, Texas.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown this 20th day of September,
1971.
