AN ORDINANCE REPEALING ALL ORDINANCES, OR PARTS OF
ORDINANCES, OR AMENDMENTS THERETO, THAT CONFLICT
WITH THE TERMS OF CONDITIONS OF THIS ORDINANCE AND
ENACTING IN LIEU THEREOF A NEW ORDINANCE, REGULATING
PLUMBING WORK IN THE CITY OF BAYTOWN, TEXAS; DEFINING
CERTAIN TERMS; PROVIDING FOR CERTAIN EXEMPTIONS:
PROVIDING FOR THE ESTABLISHING CERTAIN FEES; PRO-
VIDING FOR SPECIFICATIONS, MATERIALS AND METHODS OF
PLUMBING INSTALLATION; PROVIDING PENALTIES FOR VI-
OLATION OF THIS ORDINANCE; CONTAINING A SEVERABILITY
CLAUSE AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE
DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Chapter 24 of the Code of Ordinance of
the City of Baytown is hereby repealed in its entirety.
Section 2: Be it ordained by the City of Baytown that
the City adopt a new Plumbing Code hereinafter referred to as the
"SUGGESTED PLUMBING CODE prepared by the Texas Municipal League
and distributed in the month of July, 1971 ", and is further des-
cribed by incorporation by reference in this ordinance. A copy
of said Plumbing Code is attached hereto as Ordinance Exhibit "A ".
This ordinance is to take the place of the existing Chapter 24
and should hereinafter be Codified under Chapter 24 of the City
ordinances and shall be numbered with appropriate Section numbers.
Section 3: Sec. 12.1.4
"Material and Uses"
Under Chapter 12 of the suggested Plumbing Code as adopted herein
by reference shall be amended by the deletion of Bituminized
Sewer Pipe as listed in this Section.
Section 4: Chapter 12 of the suggested Plumbing Code
as incorporated within shall be amended by the addition of a
new Section to read as follows:
Section 12.1.6 Limitation on use of Plastic Pipe.
Plastic pipe may be used in accordance with the
terms and conditions set forth in this Code, however,
in no event shall plastic pipe be placed in concrete
slabs or likewise embedded or set in concrete.
Section 5: It is further ordained by the City
Council that this Plumbing Code be Codified under Chapter
24 of the Code of Ordinances for the City of Baytown and
that this Code be properly numbered with appropriate Article
and Section numbers such that it is consistent with the other
numberical sequences in this Code.
Section 6: Repealing Clause: All ordinances or
parts of ordinances inconsistent with the terms of this ordi-
nance are hereby repealed; provided, however, that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered
by this ordinance.
Section 7: Penalty Clause: Any person, either by
himself or agent, and any firm, corporation or other entity
who violates any of the provisions of this Code shall be deemed
guilty of a misdemeanor and, upon conviction of any such vio-
lation, shall be fined in any sum not to exceed ONE HUNDRED
DOLLARS ($100.00); and each day during which such violation
continues shall constitute a separate and distinct offense.
In any case of a violation of any of the terms or provisions
of this ordinance by any corporation, the officers and agents
actively in charge of the business of such corporation shall be
subject to the penalty herein provided. Any offense defined
herein which has been defined by laws of the State of Texas
as an offense and for which has been defined by laws of the
State of Texas as an offense and for which penalty has been
prescribed shall be pnished as provided in said State Law,
and nothing herein shall be held as fixing any penalty con-
trary to a penalty provided by the laws of the State of Texas.
Section 8: Severability Clause: If any provision
of this Code, or the application thereof to any person or

circumstances, is held invalid, the remainder of the Code, and
the application of such provision to other persons or cir-
cumstances, shall not be effected thereby.
Section 9: Effective Date: This ordinance shall
take effect from and after ten (10) days from its passage by
the City Council. The City Clerk is hereby directed to give
notice hereof by causing this ordinance to be published in
its entirety in the official newspaper of the City of Baytown
at least twice within ten (10) days after the passage of this
ordinance.
