AN ORDINANCE TO THE CODE OF ORDINANCES OF THE CITY
OF BAYTOWN, TEXAS, AMENDING CHAPTER 17; THEREBY
CREATING A NEW SECTION PROHIBITING THE OPERATION
OF MOBILE SERVICE UNITS; PROVIDING FOR A PENALTY
CLAUSE, CONTAINING A SAVINGS CLAUSE AND PROVIDING
FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That Article 17 of the Code of Ordinances
for the City of Baytown shall be amended by the addition of a
new section which shall read as follows:
Section 17 -12.1 Mobile Service Units Prohibited.
(a) It shall be unlawful for any person, firm,
partnership, corporation, or other association to
operate a mobile service unit within the City of
Baytown. As used in this Section, the term 'mobile
service unit' means any vehicle, tank truck, or
other mobile device from which flammable liquids
used as motor fuels may, as an act of retail sale,
be dispensed into the fuel tank of a motor vehicle
parked on an off - street parking facility.
(b) Any person who shall violate the provisions
of paragraph (a) of this section shall be deemed
guilty of a misdemeanor and, upon conviction,
shall be fined in a sum not to exceed two hundred
dollars ($200,00) for such offense, and each day
that paragraph (a) is violated shall constitute a
separate offense and be punished separately; and
any person, engaged in such violation shall, on
conviction, be so punished therefor.
Section 2: Savings Clause: If any provision, section,
exception, subsection, paragraph, sentence, clause or phrase of
this ordinance or the application of same to any person or set
of circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their appli-
cation to other persons or sets of circumstances and to this end
all provisions of this ordinance are declared to be severable.
Section 3: Effective Date: This ordinance shall take
effect from and after ten (10) days after its passage by the
City Council. The City Clerk is hereby directed to give notice
hereof by causing the caption of this ordinance to be published
in the official newspaper of the City of Baytown at least twice
within ten (10) days after its passage.
