AN ORDINANCE AMENDING ARTICLE II (BOARDS AND COMMISSIONS),
DIVISION 4 (PLANNING COMMISSION), SECTIONS 2 -48, 2 -49, 2 -50,
AND 2 -51 OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN,
TEXAS, FOR THE PURPOSE OF ENLARGING THE MEMBERSHIP OF THE
PLANNING COMMISSION AND SETTING MEETING ATTENDANCE GUIDE-
LINES, REPEALING ORDINANCES INCONSISTENT HEREIN; CONTAINING
A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS.
Section 1: That Sections 2 -48, 2 -49, 2 -50 and 2 -51 of
Division 4 of Article II of the Code of Ordinances of the City
of Baytown, Texas, be, and the same is hereby amended so that it
shall hereafter read as follows, to -wit:
Section 2 -48. Commission created.
An agency of the City Council is hereby created
which shall be known as the Baytown Planning Commission,
and such Commission shall consist of nine (9) members.
Section 2--49. Makeup of Commission.
The Commission shall, at all time have thereon at
least one (1) businessman, one (1) realtor, one (1)
attorney, and one (1) architect or engineer. Five (5)
members shall be appointed during odd numbered and
four (4) members shall be appointed during even numbered
years. Such appointments shall coincide with the terms
served by the City Council members.
Section 2 -50. Appointment of New Members.
As the terms of office of the individual members
terminate, the City Council shall, as soon as possible
appoint members to fill such vacancies for a term of
two (2) years. The Council, if interim vacancies occur,
shall appoint a successor for the remainder of such
term.
Section 2 -51. Attendance at Meetings; Chairman.
Any Commission member who misses three consecutive
regular meetings without valid reason shall be deemed no
longer interested in serving and the Commission shall
ask the City Council to appoint a new member to fill the
vacancy.
The Commission shall elect a Chairman at the first
meeting of each year.
Section 2: Repealing Clause: All ordinances or parts
of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be
only to the extent of such inconsistency and in all other respects
this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 3: Savings Clause: If any provision, section,
exception, subsection, paragraph, sentence, clause or phrase of
this ordinance or the application of same to any person or set
of circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their appli-
cation to other persons or sets of circumstances and to this end
all provisions of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown,
Texas.

the City Council of the City of Baytown, Texas, on this 20th
