AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF BAYTOWN; AMENDING ARTICLE 7 SECTION 33 -27;
THEREBY REMOVING THAT PORTION OF THE ORDINANCE
DEALING WITH ABANDONED VEHICLES; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE
THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of
Baytown, Texas is hereby amended by the amendment of Article 4
Section 33 -27 of the Baytown Code of Ordinances; removing and
repealing the portion of said Section dealing with Abandoned
Automobiles considered amended to read as follows; to -wit:
Section 33 -27 Care of Premises.
All land areas shall be kept free from organic and in-
organic material that might become a health, accident, or
fire hazard as defined herein. All land areas, improved
and unimproved, shall be kept reasonably clean at all times.
Containers with covers shall be provided for the temporary
storage of garbage and rubbish. Materials of an inflam-
mable nature shall be safely stored as provided in the
Fire Code or removed from the premises. It shall be un-
lawful for the owner or occupant of a residential building,
structure or property to utilize the premises of such
residential property for the open storage of icebox,
refrigerator, stove, glass, building material, building
rubbish or similar items. It shall be the duty and re-
sponsibility of every such owner or occupant to keep
the premises of such residential property clean and to
remove from the premises all such abandoned items.
Section 2: Savings Clause: If any provision, section,
exception, subsection, paragraph, sentence, clause or phrase of
this ordinance or the application of same to any person or set
of circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their appli-
cation to other persons or sets of circumstances and to this
end all provisions of this ordinance are declared to be severable.

Section--3:_ Repealing Clause: All ordinances or parts
of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be
only to the extent of such inconsistence and in all other re-
spects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this
ordinance.
Section 4: Effective Date: This ordinance shall take
effect from and after ten (10) days after its passage by the
City Council. The City Clerk is hereby directed to give notice
hereof by causing the caption of this ordinance to be published
in the official newspaper of the City of Baytown at least twice
within ten (10) days after its passage.
