Ordinance No. 1,091ORDINANCE NO. 1091 AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON THE 4TH DAY OF MAY, 19171, FOa THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT LARGE; AND ?TREE COUNCILMEN FROM THE RES- PECTIVE DISTRICTS NOS. TWO (2), THREE (3) AND SIX (6); PRO- VIDING FOR ELECTION OFFICERS, DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. WHEREAS, on the 6th day of April, 1971, the Regular Municipal Election of the City of Baytown was held in said City for the purpose of electing a Mayor from the City at large, and three Councilmen from the respective Districts Nos. 2, 3 and 6, and the returns of said Election having been duly made by the Election officials and the City Council having canvassed said returns and determined the results of said Election on this 14th day of April, 1971; and WHEREAS, it is determined from, the canvassing of said returns that no candidate for Mayor from the City at large, and no cnndidate from the respective Districts Nos. 2, 3 and 6 received a majority of the votes cast at the regular election for the offices of which they were candidates, and, accordingly, pursuant to Section 94 of Article IX of the Charter of the City of Baytown, it is the duty of the City Council to order a special election for the purpose of submitting to a vote, of the qualified voters of said City, the names of the two eligible candidates receiving the highest number of votes at the regular election for the office of Mayor from the City at large, and for the offices of Councilmen from the respective Districts Nos. 2, 3 and 6, in order that the voters may designate and elect one of the two candidates from the City at large and from the said Districts Nos. 2, 3 and 6, as Mayor and Councilmen, respectively; and WHEREAS, in ordering such special election, it is the duty of the City Council to determine the eligibility of the candidates whose names are to appear on the ballot for said election; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby finds, determines and declares that Tom Gentry, who received the second highest number of votes for Mayor from the City at large, was ineligible as a candidate for such office at all times material to such election, in that he is not a qualified voter of the State of Texas as required by Section 13 of the City Charter, and that he has not resided within the state for a period of twelve (12) months next preceding the 31st day before the election, as required by Article 1.05 of the Texas Election Code; accordingly, the City Council finds and determines that, under the pro- visions of Article 1.06 of the Texas Election Code, the said Tom Gentry may not be certified as an eligible candidate for such special election. Section 2: As determined by the canvass of the election returns this day accomplished by the City Council, the two eligible candidates receiving the highest number of votes for the office of Mayor from the City at large and for the office of Councilman from the respective Districts Nos. 2, 3 and 6 are as follows, to -wit: FOR MAYOR 'FROM CITY AT LARGE) C. It was then duly moved and seconded that said ordinance be adopted; and, after due discussion, said motion, carrying with it the adoption of said ordinance, prevailed and carried by the following vote: AYES: All members of said Council shown present above voted "Aye." NOES: None 2. That a true, full, and correct copy of the aforesaid ordinance adopted at the meeting described in the above and foregoing paragraph is attached to and follows this certificate; that said ordinance has been duly recorded in said Council's minutes of said meeting; that the above and foregoing paragraph is a true, full, and correct excerpt from said Council's minutes of said meeting pertaining to the adop- tion of said ordinance; that the persons named in the above and fore- going paragraph are the duly chosen, qualified, and acting officers Page 1 of 2 pages t and members of said Council as indicated therein; that each of the officers and members of said Council was duly and sufficiently noti- fied officially and personally, in advance, of the time, place, and purpose of the aforesaid meeting and that said ordinance would be intro- duced and considered for adoption at said meeting, and each of said officers and members consented, in advance, to the holding of said meeting for such purpose; that said meeting was open to the public as required by law; and that public notice of the time, place, and subject of said meeting was given as required by Vernon's Article 6252 -17, as amended. 3. The Mayor of said City has approved, and hereby approves, the aforesaid ordinance; the Mayor and the City Clerk of said City have duly signed said ordinance; and the Mayor and City Clerk of said City hereby declare that their signing of this certificate shall also con- stitute the signing of the attached and following copy of said ordinance for all purposes.
