AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 2, ADMINIS-
TRATION, ARTICLE II, BOARDS AND COMMISSIONS, BY THE ADDITION
OF A NEW DIVISION, TO -WIT: DIVISION 7, BAYTOWN MUSEUM AD-
VISORY BOARD, REPEALING ORDINANCES INCONSISTENT HEREWITH
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of
Baytown, Texas, is hereby amended by amending Chapter 2, Administration,
Article II, Boards and Commissions, by the addition of a new division,
to -wit: Division 7, Baytown Museum Advisory Board, thereto, which
shall read as follows, to -wit:
Division 7. Baytown Museum Advisory Board
Section 2 -66. Created, membership
There is hereby constituted and created a seven (7) member
advisory board which shall assist and advise the City Council
in ways and means of providing and developing a museum for the
City of Baytown. Such board shall be known as the "Baytown
Museum Advisory Board ".
Section 2 -67. Terms of office; qualifications; appointment
of members
Of the original seven members, two (2) shall be appointed
for three years, two (2) shall be appointed for two years, and
three (3) shall be appointed for one year. Thereafter, appoint-
ments to the Board shall be for three (3) year terms. A term of
office shall commence on April lst of the initial year of appoint-
ment. Such members shall be appointed by the City Council. All
members of the Board shall be qualified voters and residents of
the City. The Director of Parks & Recreation shall be an ex-
officio member of the Board.
Section 2 -68. Location of Operation
The operation of the museum shall be under the supervision
of the Director of Parks & Recreation and such activity shall
be maintained in the Community Building, or at such other loca-
tion approved by the Board and the City Council.
Section 2 -69. Funds for private donations
The Board is authorized to create a fund for the receipt
of private gifts or contributions from members of the community.
Such fund shall be maintained by the Board, and records thereof
shall be kept in accordance with sound accounting principles.
Funds collected by the Board may be expended as deemed advisable
by the Board.
Section 2 -70. Rule making authority
The Board shall have the authority to promulgate rules and
regulations covering the policies and operations of its activities.
Such rules and regulations as are promulgated by the Board shall be
subject to the approval of the City Council.
Section 2 -71. Procedures for receipt of artifacts
The Director of Parks & Recreation is hereby designated
as the official responsible for receiving artifacts and other items
received for the museum, in compliance with rules and policies adopted
by the Board. He shall issue receipts for the same, and shall place
such items in designated storage areas. The Director shall exercise
reasonable prudence and precaution for the safekeeping of all such
items. A serial numbered journal shall be maintained for the recording
of such items, showing the name of the donor, the date received and
other pertinent data.
Section 2: Repealing Clause: All ordinances or parts of
ordinances inconsistent with the terms of this ordinance are hereby
repealed; provided, however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the
subject matter covered by this ordinance.
Section 3: Effective Date: This ordinance shall take
effect from and after its passage by the City Council.

City Council of the City of Baytown on this 25th day of March, 1971.
