AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 2, ADMINIS-
TRATION, ARTICLE II, BOARDS AND COMMISSIONS, DIVISION 2,
LIBRARY ADVISORY BOARD, BY AMENDING SECTION 2 -26 THEREOF,
REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A
SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of
Baytown, Texas, is hereby amended by amending Chapter 2, Administration,
ARticle II, Boards and Commissions, Division 2, Library Advisory Board,
by amending Section 2 -26 thereof, which shall read as follows, to -wit:
Section 2 -26. Library advisory board created; membership.
There shall be appointed an advisory board which shall
assist the City in the proper establishment and operation
of a library, as set forth below, and such board shall be
known as the Baytown Library Board. The City Manager shall
appoint advisory board members with the approval of the City
Council. Prior to March, 1971, such board consisted of
five (5) members; an additional two members shall be appointed
effective March, 1971, increasing the membership of the board
from five (5) to seven (7) members. One of the new membership
positions appointed in March, 1971 shall serve for one (1)
year and the other shall serve for two (2) years. Thereafter,
four (4) members shall be appointed during odd - numbered years
and three (3) members shall be appointed during even - numbered
years.
Library Board members may serve not pore than three (3)
consecutive terms.
All members of the board shall be qualified voters and
residents of the City. Should vacancies occur in the board such
vacancies shall be filled in the same manner as original appoint-
ments except such terms shall only be for the remainder of such
unexpired tern.
Section 2: Repealing Clause: All ordinances or parts of
ordinances inconsistent with the terms of this ordinance are hereby re-
pealed; provided, however, that such repeal shall be only to the extent
of such inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing -the subject matter
covered by this ordinance.
Section 3: Savings Clause: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this ordinance or
the application of same to any person or set of circumstances, shall for
any reason be held unconstitutional, void or invalid, such invalidity
shall not affect the validity of the remaining provisions of this ordinance
or their application to other persons or sets of circumstances and to this
end all provisions of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after
its passage by the City Council of the City of Baytown, Texas.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, Texas, on this 28th day of January, 1971.
