ORDINANCE NO. 1064
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
BAYTOWN, TEXAS, BY THE ADDITION OF A NEW CHAPTER, TO-WIT:
CHAPTER 30, "TRUCK ROUTES ", SO AS TO REGULATE THE WEIGHT
OF COMMERCIAL MOTOR VEHICLES WITH A TRAILER, SEMI- TRAILER
OR OTHER VEHICLE ATTACHED THERETO, BEING OPERATED OVER, ON
OR UPON CERTAIN STREETS IN THE CITY OF BAYTOWN; PROVIDING
FOR ISSUANCE OF A PERMIT UNDFR CERTAIN CIRCUMSTANCES; PRO-
VIDING A PENALTY CLAUSE; REPEALING ORDINANCES INCONSISTENT
HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR
THE PULLICATION AND EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of Baytown,
Texas, is hereby amended by the addition of a new chapter, to -wit: Chapter
30, "Truck Routes ", which shall read as follows, to -wit:

Truck Routes
Section 30 -1. Statement of Intent and Purpose of Chapter.
It is the intent and purpose-of the City Council of the
City of Baytown, by the terms of this chapter, to regulate the
weight of commercial motor vehicles, trucks or other motor ve-
hicles attached thereto being operated over, on or upon certain
streets in the City of Baytown as hereinafter set forth. Some
of these streets are located in the residential sections of the
City and were constructed primarily for light traffic such as
the use of automobiles by persons residing in the vicinity
thereof. The remainder of the streets are located in the busi-
ness districts and the highly congested areas of the City where
slow, heavy commercial trucks constitute a hazard and detriment
to traffic. The purpose of this chapter is to prevent the de-
terioration of residential streets by heavy commercial vehicles
and also to promote safe and orderly traffic conditions in the
highly congested reas of the City.
Section 30 -2. It shall be unlawful for any commercial motor
vehicle, truck, tractor or other motor vehicle with a trailer,
semi - trailer or other vehicle attached thereto, to be operated
over, on or upon any street or streets or alleys within the
corporate limits of the City of Baytown where the manufacturer's
rated load carrying capacity thereof exceeds two thousand (2,000)
pounds, except the hereinafter specific streets which are hereby
designated as truck routes, to -wit:
Bayway Drive - from Decker to Wisconsin
Wisconsin - from end to end
Market Street - from 3400 block at its intersection with
Fenley Street to the "Y" intersection of West Main at
Market Street.

Wooster -Cedar Bayou Road - from Airhart to Bayway Drive
Provided, however, that the heretofore described vehicles may
use the other streets within the City in order to fulfill
local commercial obligations as permission to do so is granted
by the Chief of Police or his designated officer. If any
applicant for an exception is dissatisfied with the decision
of the Chief of Police or his designated officer, then, such
applicant may appeal to the City Council, and the City Council
may reverse or approve the decision of the Chief of Police or
his designated officer.
Section 30 -3. The provisions of this chapter shall not apply
to buses operated by the Goose Creek Independent School District
or by any person, firm or corporation having a franchise from
the City to engage in the business of public transportation.
Section 2: Penalty Clause: Any person who violates any
provision or provisions of this ordinance shall be punished by a fine
of not more than Two Hundred ($200.00) Dollars, and each violation shall
constitute a separate offense.
Section 3: Repealing Clause: All ordinances or parts of ordi-
nances inconsistent with the terms of this ordinance are hereby repealed;
provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative
of other ordinances regulating and governing the subject matter covered
by this ordinance.
Section 4: Savings Clause: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances, shall for any
reason be held unconstitutional, void or invalid, such invalidity shall not
affect the validity of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 5: Effective Date: This ordinance shall take effect
from and after ten (10) days after its passage by the City Council. The

City Clerk is hereby directed to give notice hereof by causing the caption
of this ordinance to be published in the official newspaper of the City of
Baytown at least twice within ten (10) days after its passage.
INTRODUCED, READ and PASSED by the affirmative vote of the
