Ordinance No. 1,047ORDINANCE NO. 1047 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 17, MISCELLANEOUS PROVISIONS AND OFFENSES, BY THE ADDITION OF A NEW SECTION, SECTION 17 -17, ENTITLED "FEMALE SOLICITING TO HAVE INTERCOURSE FOR COMPENSA- TION", SO AS TO MAKE IT UNLAWFUL FOR ANY FEMALE PER- SON TO OFFER TO HAVE SEXUAL INTERCOURSE WITH ANY MALE PERSON IN RETURN FOR COMPENSATION; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAV- INGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 17, Miscellaneous Provisions and Offenses, by the addition of a new section, which shall read as follows, to -wit: Section 17 -17. Female soliciting to have intercourse for compensation. (a) It shall be unlawful for any female per- son, by word, sign or action, on the streets or in any public place, or at the door or window of any house or room, or upon the porch or steps of any house or room, or upon the driveway, walk or ap- proach to any house or room, or upon the yard or premises upon which any house or room is situated, or in or upon any building or room or part thereof appurtenant to any house or premises within the corporate limits of the City, to seek to have, or offer to have sexual intercourse with any male per- son in return for compensation or remuneration by such male person. (b) Any person found guilty of violating the terms of this section shall, upon conviction, be punished by a fine not exceeding two hundred ($200.00) dollars. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this or- dinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. 41001"J", ,MljUk Section 3: Savings Clause: If any provision, sec- tion, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordi- nance or their application to other persons or sets of cir- cumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: This ordinance shall take effect from and after ten (10) days after its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after its passage.
