AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, APPROVING AN ADDENDUM TO A CERTAIN AGREEMENT BE-
TWEEN THE CITY OF BAYTOWN AND THE CITY OF MONT BELVIEU
APPORTIONING THE EXTRATERRITORIAL JURISDICTION OF THE
TWO CITIES; AND PROVIDING FOR THE EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section l: That the City Council hereby approves an
addendum to a contract between the City of Baytown and the
City of Mont Belvieu executed pursuant to authorization granted
by the City Council by ordinance No. 1039, adopted on the 3rd
day of September, 1970. The purpose of such addendum is to
amend the description of the line apportioning the extraterri-
torial jurisdiction of the two cities. Such amended descrip-
tion is attached hereto as Exhibit "A" and is made a part
hereof for all purposes®
Section 2: Tihis ordi-nance shall become effectivi
from and after its passage by the City Council of the City

EXHIBIT "A"
BEGINNING at a point in the north right of way line of Inter-
state Highway 10, two miles east of the intersection of State
Farm Market Road 2354 and Interstate Highway 10; said point
being the extraterritorial jurisdictional line of the City
of Baytown;
THENCE, west along the north right of way line of Interstate
Highway 10 to its intersection with the centerline of Cedar
Bayou Stream;
THENCE, northwesterly along the meanders of the Cedar Bayou
Stream to the westerly line of a municipal annexation com-
pleted by the City of Mont Belvieu on June 8, 1970;
THENCE, northerly along the said westerly line of such City
of Mont Belvieu annexation to a point which is beyond the ex-
traterritorial jurisdiction of the City of Baytown.
It is specifically agreed and understood that it is the in-
tention of the parties hereto to include within the extrater-
ritorial jurisdiction apportioned and assigned unto the City
of Mont Belvieu all of Chambers County Water Control & Im-
provement District No. 1, as well as all of that area annexed
by the City of Mont Belvieu on or about June 8, 1970, and
which would otherwise have fallen within the extraterritorial
jurisdiction of the City of Baytown except for these presents.
PROVIDED, HOWEVER, it is specifically agreed and understood
that the City of Baytown is granted the exclusive jurisdiction
of the Cedar Bayou Stream, in all areas over which the City
of Mont Belvieu might otherwise have jurisdiction except for
these presents. Such exclusive jurisdiction shall include,
but shall not be limited to, the exercise of authority over
industrial, commercial, municipal and other discharges into
Cedar Bayou Stream, as presently vested by law in the City
of Baytown, and as may hereafter be vested in the City of
Baytown; and all aspects of the navigation of Cedar Bayou
Stream. The City of Mont Belvieu further specifically cove-
nants to recognize the exclusive jurisdiction of Cedar Bayou
Stream in the City of Baytown as herein set forth, and recognizes
that this grant of authority and /or release of jurisdiction
shall be binding against the City of Mont Belvieu and will
never be contested by the said City of Mont Belvieu in any
legal proceeding, or otherwise.
