AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN REQUIRING
THAT NUCLEAR FALLOUT SHELTERS BE PROVIDED IN BUILDINGS CONSTRUCTED
OR REMODELED BY THE CITY WITH PUBLIC FUNDS; ESTABLISHING STANDARDS
FOR SUCH SHELTERS, AND PERMITTING CERTAIN EXCEPTIONS; PROVIDING
FOR THE ADMINISTRATION OF THIS ORDINANCE; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: Every officer, department, board or commission of the City
of Baytown, charged with the duty of preparing plans and specifications, or
awarding or entering into contracts for the design, erection or construction
of buildings, or other structures, including additions to existing structures
for the City of Baytown, shall incorporate or cause to be incorporated in
all preliminary plans for such buildings, or other structures, fallout pro-
tection for at least their normal anticipated population which shall meet
or exceed the minimum space and fallout protection criteria recommended by
the Office of Civil Defense, United States Department of Defense. Such
preliminary plans shall be reviewed by a qualified fallout shelter analyst,
and an estimate of the additional net cost for the inclusion of such fall-
out shelter shall be made. Fallout shelters shall be incorporated in the final
plans for such buildings unless exempted from such shelter requirement in
accordance with Section 2 of this ordinance.
Section 2: That the City Council may exempt a building or structure
from the provisions of this ordinance when it finds that such incorporation
of fallout shelters will create an additional net cost in the construction
of such structure in excess of four percent (4%) of the estimated cost thereof
without the shelter being so incorporated, or such other factors as it may
determine make the incorporation of a fallout shelter in such structure
unnecessary or impracticable.
Section 3: It shall be the policy of the City Council of the City of
Baytown that fallout shelters be incorporated in all public buildings of the
City to the fullest extent practicable, in order to provide protection against
radiation for the greatest number of people in the event of nuclear attack.
Section 4: This ordinance shall take effect inmiediately upon its
passage.
