Ordinance No. 1,035A01 1"10 11010y" AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE AND CLOSING DESCRIBED PORTIONS OF STREETS IN BUSCH TERRACE SUBDIVISION IN THE CITY OF BAYTOWN AND ABANDONING AND QUIT- CLAIMING ALL INTEREST OF THE CITY Or BAYTOWN AND THE PUBLIC IN AND TO SAID PORTIONS OF STREETS, DIRECTING THAT THE COUNTY CLERK OF HARRIS COUNTY, TEXAS, SO INDICATE ON THE RECORDED PLAT OF SAID SUBDIVISION, AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST' A CONVEYANCE TO THE ABUTTING OWNERS. WHEREAS the following portions of streets in Busch Terrace Subdi- vision in the City of Baytown, Harris County, Texas, according to the map and plat thereof recorded in Volume 9, Pages 10 and 11, of the Deed Records of Harris County, Texas,, are not now used by the public: 1. Long Street: Beginning at the southeast corner of Block No. 48 of said subdivision; Thence S 33' 34' W 60 feet to a point in the south line of Long Street; Thence N 56' W 93 feet to a point in the south right of way line of Long Street; Thence N 33' 34' E 60 feet to the southeast corner of Lot No. 11, Block No. 48; Thence S 56' E 93 feet to the point of beginning. 2. Powell Street: Beginning at the southeast corner of Block No. 43 of said subdivision; Thence S, 33' 34' W 60 feet to a point in the northeast corner of Block No. 48; Thence N 56' W 94 feet to the north- west corner of Lot No. 1, Block No. 48; Thence N 33' 34' E 60 feet to the southwest corner of Lot No. 24, Block No. 43; Thence S 56' E 94 feet to the point of beginning. 3. Meek Street: Beginning at the southeast corner of Block No. 38 of said subdivision; Thence S 33' 34' W 60 feet to the northeast corner of Block No. 43; Thence N 56' W 97 feet to the northwest corner of Lot No. 1, Block No. 43; Thence N 33' 34' E 60 feet to the southwest corner of Lot No. 28, Block No. 38; Thence S 56" E 97 feet to the point of beginning. 4. Crawford Street: Beginning at the southeast corner of Block No. 36 of said subdivision; Thence N 33* 34' E 400 feet to the northeast corner of Lot No. 13, Block No. 36; Thence S 56' E 60 feet to the northwest corner of Lot No. 44, Block No. 37; Thence S 330 34' W 400 feet to the southwest corner of Block No. 37; Thence N 56' W 60 feet to the point of beginning. 5. Damon Street: Beginning at the northeast corner of Block No. 4 of said subdivision; Thence S 56' E 60 feet to the northwest corner of Block No. 5; Thence S 34' W 125 feet to the southwest corner of Lot No. 1, Block No. 5; Thence N 56' W 60 feet to the southeast corner of Lot No. 8,, Block No. 4; Thence N 34' E 125 feet to the point of beginning; and WHEREAS no interest of the public requires that said portions of W A1111111%, streets be improved or kept open, but the needs of the public will be adequately served by the use of other available streets; and WHEREAS the interest of the public will be benefited by the termination of any obligation on the part of the City of Baytown to repair, improve and maintain said portions of streets as public ways; and WHEREAS substantially all of the utility facilities, if any, provided for property abutting upon the above-described portions of streets have heretofore been removed; and WHEREAS all of the owners of property abutting or adjoining the above-described portions of streets in said subdivision have made applica- tion that same be discontinued, closed and abandoned as streets and that the dedications made in connection with said map or plat of Busch Terrace Subdivision of record as aforesaid be cancelled and held for naught insofar as the same apply to and affect the above-described portions of streets; and WHEREAS, it appears to be to the best interest of the City of Baytown, Harris County, Texas, that the above- described ibed portions of streets #011111 be discontinued, closed and abandoned as streets and that the corresponding portions of said map or plat be vacated, and it further appears that the interest of no other owners of property in said Busch Terrace Subdivision will be prejudiced or impaired thereby: NODW, THEREFORE, BE IT ORDAINED by the City Council of the City of Baytown, Texas, that the above-described portions of streets in Busch Terrace Subdivision, City of Baytown, Harris County, Texas, according to the map or plat of said subdivision of record in Volume 9, Pages 10 and 11 of the Deed Records of Harris County, Texas, be and the same are hereby discontinued and abandoned for public use, and the City of Baytown does for itself and for the public abandon and quitclaim all interest in and to the above-described portions of streets and does hereby approve the application of said owners of the property abutting said portions of streets, and the County Clerk of Harris County, Texas, is directed to write across the corresponding portions of said plat the word "closed" and also to make reference on the same to the volume and page in which this ordinance is recorded. The Mayor is hereby authorized to execute and the City Clerk to attest appropriate conveyances of said portions of streets to the owners of property abutting same.
