ORDINANCE NO. 1027
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 2, ADMINIS-
TRATION, ARTICLE II, DIVISION 1 THEREOF, SO AS TO RECON-
STITUTE THE CITY'S ADVISORY BOARD CONCERNING ENVIRONMENTAL
CONTROL; REPEALING ORDINANCES INCONSISTENT HEREWITH; CON-
TAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That Division 1, "Air and Water Conservation
Board ", of Article II, "Boards and Commissions ", of Chapter 2,
"Administration ", of the Code of Ordinances of the City of Baytown,
is hereby repealed, and the same shall cease to have force and ef-
fect from and after the effective date of this ordinance.
Section 2: That the Code of Ordinances of the City of
Baytown is hereby amended by amending Chapter 2, Article II,
Division 1, so as to read as follows, to -wit:
Division 1. Baytown Environmental Advisory Board
Section 2 -15. Board Created.
There is hereby created a nine (9) member ad-
visory board which shall assist and advise the
City Council in improving the environment in and
near the corporate limits of the City. This
board shall be known as "Baytown Environmental
Advisory Board ".
Section 2 -16. Membership.
The nine members of the Advisory Board shall be
selected as follows:
1. One (1) member shall be a City Councilman, to
be appointed by the Mayor.
2. Four (4) members to be appointed by the Mayor,
subject to the approval of the City Council,
one each from a list of nominations submitted
by the following organizations:
(a) The Bayshore Rod, Reel and Gun Club;
(b) The Texas Society of Professional Engineers;
(c) The League of Women Voters; and
(d) The American Society of Chemical, Civil or
Mechanical Engineers.
3. Four (4) members to be appointed by the Mayor, subject
to the approval of the City Council, one (1) of whom
shall represent a local Baytown industry.
At least three members of the board shall be profes-
sional engineers, chemists or biologists.
All members shall be qualified voters and residents
of the City.
Of the original members, five shall be appointed for
one year and four shall be appointed for two years.
Thereafter five shall be appointed during odd - numbered
years and four shall be appointed during even -num-
bered years. Such appointments shall coincide with
the terms served by the City Council members. If
interim vacancies occur, the Mayor shall appoint a
successor to serve the remainder of such term.
Section 2 -17. Attendance at meetings; chairman.
The board may establish its own rules as to at-
tendance of its members to its meetings. A majority
of the board may expel any member who, in the opinion
of the board, misses an unreasonable number of meetings.
The board shall elect a chairman at the first
meeting of each year.
Section 2 -18. Rules of procedure.
The Board is hereby empowered to establish its
own parliamentary procedure; provided that such shall
not be in conflict with the City Charter or other
provisions of law or the following:
A quorum shall consist of a majority of
the entire membership of the board and
any issue to be voted on shall be resolved
by a majority of those present. The chair-
man shall be entitled to vote upon any
question, but shall have no veto power.
Section 2 -19. Duties.
The board shall and is hereby charged with the res-
ponsibility and duty of making studies, compiling data,
reviewing pollution monitoring reports, and doing
everything in its judgment that would be helpful in
improving the environment in and near the corporate
limits of Baytown.
Section 3: Repealing Clause: All ordinances or parts
of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 4: Savings Clause: If any provision, section,
exception, subsection, paragraph, sentence, clause or phrase of
this ordinance or the application of same to any person or set of

circumstances, shall for any reason be held unconstitutional, void
or invalid, such invalidity shall not affect the validity of the
remaining provisions of this ordinance or their application to
other persons or sets of circumstances and to this end all pro -
visions of this ordinance are declared to be severable.
Section 5: Effective Date: This ordinance shall take
effect from and after ten (10) days after its passage by the City
Council. The City Clerk is hereby directed to give notice hereof
by causing the caption, of this ordinance to be published in the
official newspaper of the City of Baytown at least twice within
ten (10) days after its passage.
INTRODUCED, READ and PASSED by the affirmative vote
of the City Council of the City of Baytown, on this the 23rd day
