AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, REPEALING ORDINANCES NOS. 31, 34 AND 131 ADOPTED
BY THE CITY COUNCIL ON THE 7TH DAY OF DECEMBER, 1948,
THE 21ST DAY OF DECEMBER, 1948, AND THE 13TH DAY OF
DECEMBER, 1951, RESPECTIVELY; PROVIDING FOR AND DESIG-
NATING TWO-HOUR TIME LIMIT PARKING ZONES FOR CERTAIN
DESCRIBED AREAS, STREETS, OR PORTIONS OF STREETS; DI-
RECTING THE CHIEF OF POLICE TO POST SIGNS GIVING NOTICE
OF SUCH ZONES; PROVIDING FOR THE EFFECTIVE DAYS AND TIME
OF SUCH TIME LIMIT ZONES; PROVIDING FOR CERTAIN VIOLA-
TIONS OF THIS ORDINANCE; DIRECTING THE CHIEF OF POLICE
TO INSTITUTE PROCEDURES TO ASSURE COMPLIANCE WITH THE
PROVISIONS OF THIS ORDINANCE; PROVIDING FOR DUTIES OF
MEMBERS OF THE POLICE DEPARTMENT; PROVIDING CERTAIN
PENALTIES; PROVIDING A REPEALING CLAUSE; PROVIDING A
SAVINGS CLAUSE, AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
Section 1: That Ordinances Nos. 31, 34 and 131,
adopted by the City Council on the 7th day of December,
1948, the 21st day of December, 1948, and the 13th day of
December, 1951, respectively, are hereby repealed, and the
same shall cease to have force and effect from and after
the effective date of this ordinance.
Section 2: The following named and described
areas, streets, or portions of streets, or such other areas,
streets, or portions of streets as may hereafter be included
in this section by amendment hereto, lying within the cor-
porate limits of the City of Baytown, Texas, shall consti-
tute two (2) hour time limit parking zones, as contempla-
ted by Section 18-122 of the Code of Ordinances:
Texas Avenue from Whiting Street to First Street
Sterling St. from Jones St. to Commerce St.
Pearce from Whiting St. to Commerce St.
Defee from Pruett St. to Commerce St.
Commerce from Gulf St. to Sterling St.
Ashbel from Gulf St. to Sterling St.
Gilliard St. from Gulf St. to Sterling St.
Jones from Gulf St. to Sterling St.
Main from Gulf St. to Sterling St.
Section 3: The Chief of Police is hereby di-
rected to cause the time limit parking zones above des-
cribed, or hereafter included within such time limit parking
zones, to be designated with clearly distinguishable mark-
ings or signs indicating the limits of such zones, and
the time allowed for parking in such zones.
Section 4: The time limits pertaining to the
above described time limit parking zones shall apply every
day between the hours of 8:00 a.m. and 6:00 p.m.,except
Sundays and legal holidays observed by the City.
Section 5: Violations. It shall be unlawful
and a violation of the provisions of this ordinance for
any person:
a. To permit any vehicle registered in the
name of or operated by such person to be
parked beyond the period of legal parking
established in any of the designated time
limit parking zones.
b. To park any vehicle across any line or
marking of a time limit parking zone so as
not to be entirely within the area desig-
nated by such lines or markings.
c. To deface or remove or otherwise tamper
with any sign or marking designating an area
as a time limit parking zone.
Section 6: The Chief of Police is hereby di-
rected to institute procedures to assure compliance with
the time limit restrictions imposed in the areas desig-
nated at time limit parking zones.
Section 7: Duty of Members of Police Department.
It shall be the duty of members of the Police Department
of the City of Baytown, acting in accordance with the in-
structions issued by the City Manager and Chief of Police,
to report:
a: The state license number of any vehicle
parked in violation of any of the provisions
of this ordinance.

b. The time during which such vehicle is
parked in violation of any of the provisions
of this ordinance.
c. Any other facts, a knowledge of which is
necessary to a thorough understanding of the
circumstances attending such violations.
Each such member of the Police Department shall
attach to such vehicle a notice to the owner or operator
thereof that such vehicle has been parked in violation of
a provision of this ordinance and instructing such owner
or operator to report to the Municipal Court of the City
of Baytown in regard to such violation.
Section 8: Penalties. Any person, firm or
corporation who shall violate any of the provisions of
this ordinance pertaining to overtime parking shall be
deemed guilty of an offense and shall be punished by a
fine of $4.00. If the fine is paid at the Municipal Court
on or before ten (10) days from the date of the ticket,
a $2.00 discount shall be allowed. If the fine is not
paid after the expiration of ten (10) days from the date
of the ticket, a capias may be issued, and the violator
may be required to post a bond of up to $200.00.
Section 9: All ordinances or parts of ordi-
nances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal
shall be only to the extent of such inconsistency and in
all other respects this ordinance shall be cumulative of
other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 10: If any provision, exception, sec-
tion, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person
or set of circumstances shall for any reason be held un-
constitutional, void or invalid, such invalidity shall not affect

the validity of the remaining provisions of this ordinance
or their application to other persons or sets of circum-
stances and to this end, all provisions of this ordinance
are declared to be severable.
Section 11. Effective Date: This ordinance
shall take effect from and after ten (10) days from its
adoption by the City Council of the City of Baytown, Texas,
and shall be in effect not to exceed ninety (90) days from
the effective date hereof.
