Ordinance No. 1,01812 ORDINANCE NO. 1018 go AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 14, GARBAGE AND TRASH, BY AMENDING SECTIONS 14 -24 AND 14 -25 THEREOF, PROVIDING FOR A MONTHLY GARBAGE SERVICE CHARGE; PROVIDING FOR THE METHOD OF BILLING, PAYMENT, AND COLLECTION; PROVIDING A PENALTY; AND PROVIDING FOR THE DISCONTINUANCE OF SERVICE; REPEAL- ING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BAYTOWN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 14, Garbage and Trash, by the amendment of Sections 14 -24 and 14 -25 thereof, which shall read as follows, to -wit: Section 14 -24. Charge for Collection. The City shall charge for its services for removing and disposing of garbage and refuse from houses, buildings, and premises used for residential purposes the sum of $1.75 per month for each such residence, dwelling or apartment from which garbage is collected. In the case of multi - family dwelling unit projects, the monthly charge for the collection of garbage shall be the sum of $1.75 times the number of units in the project for which water charges are made for the month. Section 14 -25. Billing; payment; penalty; dis- continuance of service. a. For convenience of collection, the monthly charge for garbage pick -up shall be added to the monthly water bills prepared by or for the City, and collection of said charge shall be made by the Water Department at the time of payment of the monthly water bill. Employees or agents of the City shall not ac- cept payment of the water bill from any owner, occupant, tenant or lessee without collecting the full amount of said bill including the charge for garbage collection. b. If the garbage service charge is not paid by the due date shown on the customer's water bill, the customer shall be charged a penalty in the amount of ten (10 %) per cent of the amount of such garbage charge, which shall +_ be shown as the gross amount on such bill; if not paid by the next billing date, such gross amount will be shown in arrears on the customer's water bill for the next month following. If the total amount of the following month's garbage service charges, including arrears and current garbage service, is not paid by the due date spe- cified on such month's water bill, then ten (10 %) per cent of the said following month's garbage service charges shall be added as a penalty and the total of the two month's charges will then be in arrears. A notice will then be sent to a cus- tomer showing the total amount due and specifying a cut -off date for the discontinuance of garbage service. If the account is not paid in full by such cut -off date, the City shall reserve the right to discontinue garbage service until all past due charges have been paid. In the event it becomes necessary to discontinue garbage ser- vice, the City Health Officer shall be notified immediately for appropriate action in accordance with the ordinances and laws regulating sanitation. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this or- dinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision, sec- tion, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this or- dinance or their application to other persons or sets of cir- cumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: The provisions of this ordinance providing for a penalty for the late payment of garbage service charges shall become effective beginning with billings for the month of April, 1970.
