AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER
17, MISCELLANEOUS PROVISIONS AND OFFENSES, BY ADDING
A NEW SECTION THERETO, TO -WIT: SECTION 17 -1.2, SO
AS TO MAKE IT UNLAWFUL TO DISCHARGE AIR RIFLES OR
AIR PISTOLS ON PUBLIC PROPERTY OR ACROSS THE PRIVATE
PROPERTY LINE OF ANOTHER; PROVIDING FOR A PENALTY
NOT EXCEEDING ONE HUNDRED AND NO /100 ($100.00) DOLLARS;
REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAIN-
ING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICA-
TION AND EFFECTIVE DATE THEREOF.
BAYTOWN:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
Section 1: That the Code of Ordinances of the City
of Baytown, Texas, is hereby amended by amending Chapter 17,
Miscellaneous Provisions and Offenses, by adding a new section
thereto, which shall read as follows, to -wit:
Section 17 -1.2. Discharging air rifles or air
pistols restricted.
a. It shall be unlawful for any person
to discharge an air rifle or air pistol of any
description, by whatever name known that by
means of compressed air, compressed gas, springs,
or any other means is capable of discharging
shots, pellets, or any solid object over any
easement, street, alley, park, road, highway,
right -of -way or over the private property line
of someone other than his own without the con-
sent of such person.
b. No person shall discharge any such air
gun or air pistol on public school grounds,
public parks, church grounds or in cemeteries,
unless the person has the approval of the person
in charge of such grounds.
c. Any person who shall violate any pro-
vision or provisions of this section shall be
guilty of a misdemeanor and, upon conviction,
shall be punished by a fine of not more than
$100.00. Each day of the continuance of such
violation shall be considered a separate offense.
Section 2: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby re-
pealed; provided, however, that such repeal shall be only to
the extent of such inconsistency and in all other respects this

ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 3: Savings Clause: If any provision,
section, exception, subsection, paragraph, sentence, clause
or phrase of this ordinance or the application of same to
any person or set of circumstances, shall for any reason be
held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances and to this end all provisions of this ordinance
are declared to be severable.
Section 4: Effective Date: This ordinance shall
take effect from and after ten (10) days after its passage
by the City Council. The City Clerk is hereby directed to
give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of
Baytown at least twice within ten (1 O) days after its pas-
sage.
INTRODUCED, READ and PASSED by the affirmative vote
of the City Council of the City of Baytown, this the 12th day
