Ordinance No. 1,011W ORDINANCE NO. 1011 W ( AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 11, ELECTRICAL CODE, BY AMENDING SECTION 11 -1(b) THEREOF, SO AS TO ALTER THE TERMS OF OF- FICE OF THE MEMBERS OF THE ELECTRICAL BOARD; RE- PEALING ORDINANCES INCONSISTENT HEREITH; CONTAIN- ING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLI- CATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 11, Electrical Code, by the amendment of Section 11 -1(b) thereof, which shall read as follows, to -wit: Section 11 -1. Membership; appointment. (b) All members of the Electrical Board shall serve for a period of two (2) years. A term of office shall coincide with two (2) calendar years. Positions Nos. One (1), Two (2) and Three (3) shall be appointed effective January lst in each even numbered year, and Positions Nos. Four (4) and Five (5) shall be appointed effective January 1st in each odd numbered year. If an interim vacancy shall occur, a successor shall be appointed for the remainder of such term. All members shall serve without compensation, and shall be subject to removal at the will of the City Council. Section 2: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 3: Repealing Clause: All ordinances or 11100YIN/b, parts of ordinances inconsistent with the terms, of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumula- tive of other ordinances, regulating and governing the subject matter covered by this ordinance.
