Ordinance No. 1,008ORDINANCE NO. 1008 IWO AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 27, SUBDIVISIONS, BY THE AMENDMENT OF APPENDIX B THERETO, DESIGNATED AS ENGINEERING AND CONSTRUCTION STANDARDS FOR SUBDIVISION, SO AS TO ESTABLISH STANDARDS FOR STREET LIGHTING IN SINGLE FAMILY RESIDENTIAL SUBDIVISION, BY THE ADDITION OF A NEW HEADING DESIGNATED "STREET LIGHTS "; REPEALING ORDINANCES INCONSISTENT HERE- WITH; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 27, Subdivisions, by the amendment of Appendix B thereof, by adding thereto a new heading entitled "Street Lights ", which shall read as follows, to -wit: STREET LIGHTS Developers will be required to install ornamen- tal metal street light standards on public streets in subdivisions within the city limits as follows: (a) The location and number of street lights shall be determined by the Planning and Zoning Commission and shall be marked on the final approved copy of ( the subdivision plat. (b) The spacing and location of street lights shall be in accordance with recommended standards of the Illuminating Engineering Society. (c) Street lights shall be located so as to be of general benefit to the surrounding neighborhood. (d) A cash payment of One Hundred Fifty ($150.00) Dollars per ornamental street light standard shall be required before building permits will be issued in a new subdivision within the city limits. This payment shall constitute a final and one time pay- ment by the developer to the City and represents the cost of a standard 3300 Lumen metal pole street light at $30.00 per year for five (5) years. (e) Where it is determined by the Planning and Zon- ing Commission that illumination greater than the standard 3300 Lumen street light is needed, the additional cost above $150.00 will be borne by the City. ,!lf 11100111- Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this or- dinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision, sec- tion, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this or- dinance or their application to other persons or sets of cir- cumstances and to this end all provisions of this ordinance are declared to be severable. , Section 4: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown, INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown, this the 8th day of January, 1970.
