BAYTOWN, TEXAS, APPROVING THE FORM AND SUBSTANCE
OF: (1) A MASTER AGREEMENT BETWEEN THE CITY OF
BAYTOWN AND THE STATE OF TEXAS CONCERNING THE
CONSTRUCTION, MAINTENANCE AND OPERATION OF OFF -
STREET PARKING AND OTHER APPROPRIATE USES ON STATE
HIGHWAY DEPARTMENT RIGHTS -OF -WAY WITHIN THE CITY
LIMITS; (E) A SUPPLEMENT TO THE SAID MASTER AGREE-
MENT FOR THE CONSTRUCTION, MAINTENANCE AND OPERATION
OF AN OFF- STREET PARKING FACILITY ON STATE HIGHWAY
146 RIGHT -OF -WAY; AND (S) A CONTRACT BETWEEN THE
CITY OF BAYTOWN AND THE MISSOURI STREET CHURCH OF
CHRIST CONCERNING THE SAID OFF - STREET PARKING FACILITY
ON STATE HIGHWAY 146 ADJACENT TO THE CHURCH; AU-
THORIZING AND DIRECTING THE MAYOR TO EXECUTE THE
SAID AGREEMENTS AND THE CITY CLERK TO ATTEST THE
SAME FOR AND ON BEHALF OF THE CITY OF BAYTOWN; IN-
CORPORATING BY REFERENCE THE TERMS OF SAID CONTRACTS
AND SPECIFICALLY APPROVING THE SAME; AND PROVIDING,
FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the City Council hereby formally
approves the form and substance of a Master Agreement dated
the 3 day of �; ,•...ry w , 1969, between the City of
Baytown and the State of Texas, concerning the construction,
maintenance and operation of off - street parking and other
appropriate uses on State Highway Department rights -of -way
within the City limits; that the City Council also hereby
formally approves the form and substance of a Supplement
Agreement to the Master Agreement above described concerning
the construction, maintenance and operation of an off- street
parking facility on State Highway 146 right -of -way adjacent
to the Missouri Street Church of Christ; that the City Council
further hereby approves the form and substance of an agreement
between the City of Baytown and the Missouri Street Church of
Christ concerning the rights and duties of the parties as to
the said parking lot adjacent to the Missouri Street Church
of Christ. A copy of each of the said contracts is attached

hereto, identified as Exhibits "A", "B", and "C", respectively,
and said contracts are hereby made a part of this ordinance.
Section 2: That the City Council hereby formally
approves the terms of each of the said contracts.
Section 3: That the Mayor is hereby authorized and
directed to execute and the City Clerk to attest the said
contracts for and on behalf of the City of Baytown.

AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CON-
STRUCTION ON A PORTION OF STATE HIGHWAY NO. 146
WITHIN THE CITY LIMITS OF BAYTOWN, TEXAS; REPEAL-
ING ORDINANCES INCONSISTENT HEREWITH; CONTAINING
A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY
OF TWO HUNDRED ($200.00) DOLLARS AND PROVIDING
FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
WHEREAS, the Texas Highway Department has made it
known to the City of Baytown that operation will begin in
the near future for the improvement of State Highway 146
from the Missouri Pacific Railroad to Loop 201; and
WHEREAS, in the interest of safety, it is desirable
to maintain a construction speed zone during the construction
period; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That a construction speed zone be es-
tablished along State Highway 146 from the Missouri Pacific
Railroad to Loop 201, a distance of approximately 2.029 miles
long, 35 miles per hour when so signed within said zone.
Section 2: Necessary signs for posting the speed
zone will be furnished, installed, and maintained by direction
of the Texas Highway Department's engineer in charge of the
project.
Section 3: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency, and in all other respects
this ordinance shall be cumulative of other ordinances regu-
lating and governing the subject matter covered by this ordinance.

Section 4: If any provision, section, subsection,
paragraph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances,
shall for any reason be held unconstitutional, void or invalid,
such invalidity shall not effect the validity of the remaining
provisions of this ordinance or their application to other
persons or sets of circumstances and to this end, all pro-
visions of this ordinance are declared to be severable.
Section 5: Any person, firm, or corporation vio-
lating any provision of this ordinance or failing to observe
any provision thereof, shall be deemed guilty of a misdemeanor
and, upon conviction, shall be fined in any sum not to exceed
T140 HUNDRED ($200.00) DOLLARS, and each and every day or frac-
tion thereof, which this ordinance, or any part thereof, shall
be violated, shall be deemed a separate offense and punishable
as such.
Section 6: This ordinance shall be in effect only
during the period of construction, and completion of the pro-
ject shall automatically cancel the speed zone. The City
Clerk is hereby directed to give notice hereof by causing
the caption of this ordinance to be published in the of-
ficial newspaper of the City of Baytown at least twice prior
to the construction period.,
