ORDINANCE NO. 992
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF
CHAPTER 2, ADMINISTRATION, BY THE ADDITION OF A
NEW ARTICLE, TO -WIT: ARTICLE VI, " BAYTOWN COM-
MUNITY ASSISTANCE BOARD "; PROVIDING FOR THE
CREATION OF THE BOARD; PROVIDING FOR BOARD MEM-
BERSHIP AND TERMS OF OFFICE; PROVIDING FOR THE
APPOINTMENT OF A CHAIRMAN; PROVIDING FOR MEET-
INGS; PROVIDING FOR RULES OF PROCEDURE; PRESCRI-
BING THE AUTHORITY AND DUTIES OF SUCH BOARD;
REPEALING ORDINANCES INCONSISTENT HEREWITH; CON-
TAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF BAYTOWN:
Section 1: That the Code of Ordinances of the City
of Baytown, Texas, is hereby amended by amending Chapter 2,
Administration, by the addition of a new Article, to -wit:
Article VI, "Baytown Community Assistance Board ", which
shall read as follows, to -wit:
ARTICLE VI. BAYTOWN COMMUNITY ASSISTANCE BOARD.
Section 2 -120. Creation.
There is hereby constituted and created
a fifteen (15) member advisory board which will
assist and advise the City Council in ways and
means of developing and expanding the resources
for the disadvantaged of the City of Baytown.
Such Board shall be known and designated as
the "Baytown Community Assistance Board ".
Section 2 -121. Membership.
Original members of the Board will be selected
in the following manner:
(a) Five (5) members selected at a
general meeting of the City's Mexican -
Americans;
(b) Five (5) members selected by the
Harris County Community Action Committee
of Baytown; and
(c) Five (5) members selected by the
Baytown Human Relations Council.
Of the original Board, three (3) of the five
(5) members selected by each group indicated above
shall serve for a term of two (2) years, and two
(2) of such members shall serve for a term of one
(1) year. Thereafter, each member shall serve a
term of two (2) years, and shall continue to serve
until his successor is named. Three (3) members
shall be selected during odd numbered years and

two (2) members shall be selected during
even numbered years. Should vacancies oc-
cur in the Board, such vacancies shall be
filled in the same manner as original ap-
pointments except such terms shall be only
for the remainder of such unexpired term.
Section 2 -122. Appointment of Chairman.
The City Council shall appoint the
Board's Chairman, who may be selected either
from the membership of the Board or from
the City at large. Terms of office shall
be from July 1 of one calendar year until
June 30 of the next applicable calendar
year. The Chairman shall serve for a term
of one (1) year beginning July 1, 1969 and
ending on June 30, 1970.
Section 2 -123. Meetings; Attendance at meetings.
Meetings of the Board will be held in
the Baytown Community Center on a regular
monthly basis on dates determined by a majo-
rity of the entire membership of the Board.
Special meetings may be called at any time
by the Chairman.
The Board may establish its own rules
as to attendance of its members to its meet-
ings. The majority of the Board may expel
any member who, in the opinion of the Board,
misses an unreasonable number of meetings.
Any expelled member shall be replaced by a
member to fill out the unexpired term as
provided above.
Section 2 -124. Rules of Procedure.
The Board is hereby empowered to esta-
blish its own parliamentary procedures; pro-
vided that such shall not be in conflict with
the City Charter or other provisions of law.
A quorum shall consist of a majority of the
fifteen (15) Board members, and any issue to
be voted on shall be resolved by a majority
of those present. The Chairman shall be en-
titled to vote upon any question, but shall
have no veto power.
Section 2 -125. Advice to City Manager and City Council.
Said Board is hereby authorized to assist
and advise the City Manager and City Council
and make recommendations to the said Manager
and Council about any matter that it deems
beneficial to the administration of the pur-
poses for which it was created; provided, that
such function shall not contravene with the
City Charter or with any other law and shall be
considered advisory only.
Section 2 -126. Duties; reports.
Said Board shall perform such functions
as may be duly delegated to it from time to
time by the City Council. The Board is fur-
ther hereby charged with the responsibility of
performing the following duties or otherwise
advising the City Council with regard to them:

(a) Determining the services and aid
available to disadvantaged people in the
Baytown area;
(b) Act as an information service in as-
sisting persons desiring to help the disad-
vantaged contact the appropriate agency or
group;
(c) Remain abreast of and coordinate with
the activities of the Baytown Human Rela-
tions Council, the Harris County Community
Action Committee and the Community Chest
activities, and other related groups.
(d) Determining methods of seeking additional
assistance for the disadvantaged of the
Baytown area;
(e) Act as a public information body in im-
proving general communications with and
bringing about an understanding of the needs
of the disadvantaged by individuals, groups
and agencies; and
(f) Recommending the utilization of the re-
sources available in Baytown for the better-
ment of the disadvantaged.
Section 2: Repealing Clause: All ordinances or
parts of ordinances inconsistent with the terms of this or-
dinance are hereby repealed; provided, however, that such
repeal shall be only to the extent of such inconsistency
and in all other respects this ordinance shall be cumula-
tive of other ordinances regulating and governing the sub-
ject matter covered by this ordinance.
Section 3: Savings Clause: If any provision,
section, exception, subsection, paragraph, sentence, clause
or phrase of this ordinance or the application of same to
any person or set of circumstances, shall for any reason be
held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances and to this end all provisions of this ordi-
nance are declared to be severable.
Section 4: Effective Date: This ordinance shall
take effect from and after its passage by the City Council
of the City of Baytown, Texas.
