Ordinance No. 980ORDINANCE NO. 980 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING THE EXCHANGE OF TRACTS OF LAND OF EQUAL SIZE BY AND BETWEEN THE CITY OF BAYTOWN AND TIFFANY HOMES, INC., AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO PREPARE APPROPRIATE INSTRUMENTS EFFECTING SUCH EXCHANGE; AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE, AND THE CITY CLERK TO ATTEST, A DEED EFFECTING SUCH CONVEYANCE ON BEHALF OF THE CITY; ACCEPTING THE CONVEYANCE TO THE CITY FROM TIFFANY HOMES, INC. AND FINDING THAT SUCH CONVEYANCE IS FULL AND ADEQUATE CONSIDERATION FOR SUCH EXCHANGE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Tiffany Homes, Inc., a Texas corporation, by and through its duly authorized officers, has requested that the City of Baytown convey a tract of land of approxi- mately .45 acres to the said corporation in exchange for the conveyance of a tract of land of equal size to the City; and WHEREAS, the tract of land which the corporation desires to convey in exchange to the City is adjacent to the City's Craigmont Sewage Treatment Plant, and is described as follows, to -wit: BEING all that certain tract or parcel of land lying and being situated in the Harvey Whiting Survey, A -840, in Harris County, Texas, and being part of a 181.51 acre tract described in Deed dated October 13, 1955, from I. S. Deutser, et al, to W. D. Laird, recorded in Volume 3043, at Page 123 of the Harris County Deed Records, and being more particularly described by metes and bounds as follows: COMMENCING at the Northeast corner of that certain 181.51 acre tract described in Deed dated October 13, 1955, from I. S. Deutser, et al, to W. D. Laird, re- corded in Volume 3043, at Page 123, of the Harris County Deed Records; THENCE, with the East line of said 181.51 acre tract, South 00 1' East, 118.13 feet to the POINT OF BEGIN- NING of the tract herein described; THENCE, with the East line of said 181.51 acre tract, South 00 1' East, a distance of 147.68 feet to the corner of the North right -of -way line of Craigmont Boulevard; THENCE, South 570 35' 26" West with the North right - of -way line of Craigmont Boulevard, a distance of 117.37 feet to a corner; THENCE, North 320 24' 34" West, a distance of 125.16 feet to a corner; THENCE, North 570 43' 30" East, a distance of 196.48 feet to the POINT OF BEGINNING, containing 0.450 acres of land, more or less. WHEREAS, the tract of land presently owned by the City which is desired by the said corporation in exchange for its tract described above also lies adjacent to the City's Craigmont Sewage Treatment Plant, and is described as follows, to -wit: BEING all that certain tract or parcel of land lying and being situated in the Harvey Whiting Survey, Ab- stract No. 840, in Harris County, Texas, and being part of a 181.51 acre tract described in deed dated October 13, 1955, from I. S. Deutser et al to W. D. Laird, recorded in Volume 3043 at Page 123 of the Harris County Deed Records, also being part of a 2.102 acre tract described in deed dated April 17, 1957, from 0. L. Richardson to Harris County Water Control and Improvement District No. 58, and being more particularly described by metes and bounds as follows: COMMENCING at the Northeast corner of that certain 181.51 acre tract described in deed dated October 13, 1955, from I. S. Deutser et al to W. D. Laird recorded in Volume 3043 at Page 123 of the Harris County Deed Records; THENCE, with the East line of said 181.51 acre tract, South 00 1' East 118.13 feet to corner; THENCE, South 570 43' 30" West 389.50 feet to the POINT OF BEGINNING of the tract herein described; THENCE, from the POINT OF BEGINNING continuing South 570 43' 30" West 166.66 feet to corner; THENCE, North 890 45' 53" West 30.02 feet to corner; THENCE, North 010 20' East 152.90 feet to the South line of Humble Oil & Refining Company 3 acre tract; THENCE, along the South line of the Humble Oil & Refining Company 3 acre tract South 890 45' 53" East 168.92 feet to corner, being the Southeast cor- ner of said Humble Oil & Refining Company 3 acre tract; THENCE, South 010 20' West 63.31 feet to the POINT OF BEGINNING, containing 0.45 acre of land, more or less. -2- 5a W WHEREAS, the City Council finds that the proposed exchange of land would facilitate the City's requirement to enlarge and expand the aforesaid Craigmont Sewage Treatment Plant; and WHEREAS, the City Council further finds that in all other respects the proposed exchange of land would be in the best interest of the City of Baytown and that the value of the tract to be conveyed to the City would be full and ade- quate consideration for the City's presently owned tract; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the proposed exchange by and be- tween Tiffany Homes, Inc., a of Baytown, of tracts of lan 0.45 acres, be, and the same approved and agreed to; that from and to each of the said herein. Texas Corporation, and the City d each containing approximately is hereby, formally accepted, the said tracts to be conveyed parties are fully described Section 2: That the City Attorney is hereby au- thorized and directed to prepare appropriate deeds to effect the exchange of land herein authorized and approved. Section 3: That the Mayor is hereby authorized and directed to execute, and the City Clerk to attest, a deed for and on behalf of the City of Baytown effecting the con- veyance of the 0.45 acre tract of land above described to the said Tiffany Homes, Inc. Section 4: That the City Council hereby formally accepts the deed from Tiffany Homes, Inc. to the City of Baytown conveying the 0.45 acre tract of land above described -3- W "O"AMP" and finds that said conveyance is full and adequate considera- tion for the conveyance of land from the City to the said cor- poration herein approved and authorized. Section 5: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown, Texas. vote of the city council of the City of Baytown, this 26th day of June, 1969.
