Ordinance No. 976ORDINANCE NO. 976 id AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN APPROVING THE FORM AND SUBSTANCE OF A CONTRACT BETWEEN THE CITY OF BAYTOWN AND THE CITY OF HOUSTON PURSUANT TO THE PROVISIONS OF ARTICLE 970A, V.T.C.S., APPORTIONING THE OVER- LAPPING EXTRATERRITORIAL JURISDICTION OF THE SAID CITIES; AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE THE SAID AGREEMENT AND THE CITY CLERK TO ATTEST THE SAME FOR AND ON BEHALF OF THE CITY OF BAYTOWN; STATING BY REFERENCE THE TERMS OF SAID CONTRACT AND SPECIFICALLY APPROVING SAME; PROVIDING FOR THE EFFECTIVE DATE HEREOF. BAYTOWN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Section 1: That the City Council hereby formally approves the form and substance of a contract between the City of Baytown and the City of Houston, pursuant to the provisions of Article 970a, V.T.C.S., apportioning the over- lapping extraterritorial jurisdiction of the said cities, each city relinquishing a portion of its extraterritorial jurisdiction to the other to provide a mutually agreed upon common boundary between the extraterritorial jurisdictions of the two cities. A copy of said contract is attached hereto for reference and marked "Exhibit A ". Section 2: That the City Council hereby formally approves the description of the line agreed upon in said contract apportioning the overlapping extraterritorial juris- diction of the said cities, and forming a common.boundary between the two cities' respective extraterritorial jurisdictions. Section 3: That the Mayor is hereby authorized and directed to execute and the City Clerk to attest the said contract for and on behalf of the City of Baytown. Section 4: That the City Attorney is hereby directed to forward an executed copy of the said contract, 1114"k together with a certified copy of -this ordinance approving same, to the City of Houston. Laughlin, City Roito,rney FWC:rh, 3/18/69 THE STATE OF TEXAS § COUNTY OF HARRIS § THIS AGREEMENT is made and entered into this / J day of , 1969, by and between the CITY OF HOUSTON, a municipal corporation duly organized and existing under the laws of the State of Texas, and the CITY OF BAYTOWN, a muni- cipal corporation duly organized and existing under the laws of the State of Texas. Upon the terms and conditions set forth in this Contract, the CITY OF HOUSTON and the CITY OF BAYTOWN hereby agree that it is the mutual desire and intent of the govern- ing bodies of both c-ties, pursuant to Article 970a, V.T.C.S., to apportion the overlapping extraterritor-,_L. Jzurisdict ons of the cities of Houston and Baytown for the mutual convenience of such cities, to make the future gxpansion of municipG.l services susceptible of comprehensive planning, and to facili- tate the planning of future extensions of the boundaries of both such cities and do hereby contract as follows: ' I. The parties agree that the extraterritorial juris- dictions of both the cities of Houston and Baytown overlap, as that jurisdiction is defined in the i-.unicipal Annexation Act, in an area generally between the present corporate limi,s of such cities and it is recognized by the governing bodies of both cities that certain natural and man-made barriers will forma logical and reasonable boundary to any future expansion of the cities of Houston and Baytown toward each other, and -it - is therefore deemed in the best interest of both the cities of Houston and Baytown that the extraterritorial jurisdiction of such cities as provided for in Article 970a, V.T.C.S., shall hereby be mutually apportioned by and between the two cities along the line described in Section II of this contracto Ito The line dividing the extraterritorial jurisdiction of the City of Houston from the extraterritorial jurisdiction, of the City of Baytown is described as follows: BEGINNING at a point being the intersection of the center line of the meanders of Cedar Bayou, said center line also being the common boundary between Harris County and Liberty County, and a line parallel to and 10 feet measured at right angles northwesterly from the southeasterly right-of-way line of U. So Highway 902 the Beaumont Highway; THENCE southwesterly along a line parallel to and 10 feet from, measured at right angles north- westerly from the southeasterly right-of-way line of U. So Highway 902 the Beaumont Highway, to the westerly waters edge of the San Jacinto River; THENCE southerly along the meanders of the westerly waters edge of the San Jacinto Ri-ver to its intersection with a line parallel to and 2500 feet from measured at right angles northerly from the center line of the Houston Ship Channel as presently established by the United States Army Corps of Engineers and the present city limit of the City of Houston as established by Ordinance No, 67-2147, passed December 20, 1967; THENCE in a general southeasterly direction along the present city limit line of the City of Houston as established by Ordinance No. 67-2147, passed December 202 1967, and the extension of such line being parallel to and 2500 feet measured at right angles from the center line of the Houston Ship Channel as presently established by the United States Army Corps of Engineers to the present south- easterly limit of the extraterritorial jurisdiction of the City of Baytowno III9 From and after the date of this Contract the CITY OF HOUSTON shall have exclusive extraterritorial jurisdiction, to the exclusion of the CITY OF BAYTOWN9 in that area to the north- west, west and southwest of the line described in Section II aboveo - 2 - IV. From and after the date of this Contract the CITY OF BAYTOWN shall have exclusive extraterritorial juris- diction, to the exclusion of the CITY OF HOUSTON, in that area to the northeast, east and southeast of the line des- cribed in Section II above. V. This Agreement shall be executed in duplicate, either copy of which shall be considered to be an original copy, by the Mayor or City Manager of each City, attested by the City Secretary or City Clerk and under the corporate seal of each said City. IN TESTIMONY WHEREOF, the Cities of Houston and Baytown have authorized the execution of this Contract by the appropriate officials, such authority having been granted by resolution or ordinance of the respective governing bodies thereof.
