AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN PROVIDING RULES AND REGULATIONS PERTAIN -
ING TO PUBLIC PARKS; REPEALING ALL PRIOR ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00)
DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EF-
FECTIVE DATE HEREOF.
BAYTOWN:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
Section 1: It shall be unlawful for any person
within any public park, parkway, playground or any other
public place for public recreation to commit or do any of
the following acts:
1. To drive or propel any motor vehicle over
or through any park except along or upon
public streets or designated park drives.
2. To ride any horse over or through any park
except along and upon designated bridal
paths.
3. To hit golf balls, except "floating type"
practice balls which are incapable of doing
injury to persons or objects.
Section 2: Repealing Clause: All ordinances or
parts of ordinances inconsistent with the terms of this or-
dinance are hereby repealed; provided, however, that such
repeal shall be only to the extent of such inconsistency and
in all other respects this ordinance shall be cumulative of
other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 3: Savings Clause: If any provision, ex-
ception, section, subsection, paragraph, sentence, clause or
phrase of-this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not
the validity of the remaining provisions of this ordinance

or their application to other persons or sets of circumstances
and to this end, all provisions of this ordinance are declared
Section 4: Penalty Clause: Any person who shall
violate or fail to comply with any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon
conviction thereof shall be punished by a fine in the sum
not to exceed Two Hundred ($200.00) Dollars, and in addition
to the penalty herein provided for such violation, any neglect
or refusal to comply with any of the terms of this ordinance
shall be deemed a nuisance, and may be abated in the manner
provided by the laws and ordinances of the City for the
abatement of nuisances.
INTRODUCED, READ and PASSED by the City Council of
the City of Baytown on this 7th day of May, 1969.
