Ordinance No. 973s E61 ORDINANCE NO. 973 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AMENDING AN ORDINANCE ENTITLED: "AN OR- DINANCE CREATING AND PROVIDING FOR THE OFFICE OF REGISTRAR OF BIRTHS AND DEATHS, REQUIRING THE RE- GISTRATION OF BIRTHS AND DEATHS, PROVIDING FOR APPOINTMENT OF SUCH OFFICER AND FIXING THE COM- PENSATION, PROVIDING FOR THE KEEPING OF RECORDS, RECORDING AND ISSUANCE OF CERTIFICATES AND THE FEE THEREFOR, AND PROVIDING PENALTIES FOR VIO- LATION HEREOF, AND DECLARING AN EMERGENCY.", PASSED BY THE CITY COUNCIL OF THE CITY OF GOOSE CREEK, NOW BAYTOWN, TEXAS, ON THE 29TH DAY OF JULY, 1940, BY THE AMENDMENT OF SECTION X THEREOF, SO AS TO INCREASE THE FEE FROM $.50 PER COPY TO $1.50 PER COPY FOR CERTIFIED COPIES OF RECORDS MAINTAINED BY THE REGISTRAR OF VITAL STATISTICS FOR THE CITY OF BAYTOWN; REPEALING ALL ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, by Ordinance adopted by the City of Goose Creek, now Baytown, Texas, on the 29th day of July, 1940, the office of Registrar of Vital Statistics for the City of Baytown was created, and the duties of said office and the fees to be charged in providing certified copies of the records main- tained by said office were provided for; and WHEREAS, the said Ordinance provided for a fee of $.50 for each certified copy of any record maintained by the said Registrar; and WHEREAS, the said fee of $.50 per copy is now inadequate to fairly reimburse the City for the administra- tive cost required in providing this service; NOW THEREFORE, BAYTOWN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Section 1: That said Ordinance passed by the City Council of the City of Goose Creek, now Baytown, Texas, on the 29th day of July, 1940, be, and the same is hereby, amended by the amendment of Section X thereof, so as to read as fol- lows, to-wit: Section X: The Registrar of Vital Statistics shall, upon the payment of $1.50, issue a certified copy of any record within his keeping except such as forbidden by Rule 47a, Article 4477, R.C.S. of Texas. Section 2: Except as amended herein, the said Ordinance above mentioned shall continue in full force and effect. Section 3: Repealing Clause: All ordinances or parts of ordinances, inconsistent with the terms of this or- dinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject mat- ter covered by this ordinance. Section 4: Savings Clause: If any provision, ex- ception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this or- dinance or their application to other persons or sets of cir- c,umstances and to this end, all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinance shall become effective from and after passage by the City Council. of the City Council of the City of Baytown, on this 7th day of May, 1969.
