Ordinance No. 969ORDINANCE NO. 969 AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY OF BAYTOWN, TEXAS, ON THE QUESTION OF THE ADOPTION OF A COMPREHENSIVE ZONING ORDINANCE FOR THE SAID CITY; DESIGNATING THE HOURS AND THE DAY OF THE ELECTION AND THE POLLING PLACES THEREFOR; APPOINT- ING ELECTION OFFICIALS THEREFOR; PROVIDING THAT ALL DULY QUALIFIED RESIDENT ELECTORS SHALL BE QUALIFIED TO VOTE; PRESCRIBING FORM OF BALLOT; PROVIDING FOR NOTICE OF ELECTION; CONTAINING OTHER PROVISIONS RE- LATING TO SAID ELECTION AND PROVIDING A SEVERABILITY CLAUSE. WHEREAS, the Planning & Zoning Commission of the City of Baytown, together with the City Council, has reviewed the feasibility of zoning for the City of Baytown for more than two years; and WHEREAS, the said Planning & Zoning Commission pre- viously submitted its preliminary report to the City Council, and subsequent thereto held several work sessions jointly with the City Council concerning a zoning ordinance for the City; and WHEREAS, the City Council, being desirous of sa- tisfying conditions precedent to the adoption of a zoning ordinance for the City, called a joint public hearing, after due notice as required by law, before the Planning & Zoning Commission and the City Council to give interested parties an opportunity to be heard concerning the question of zoning; and WHEREAS, such public hearing was convened in the Council Chambers of the City Hall at 7:00 p.m. on Monday, March 10, 1969, and was recessed until the same time and place on March 17, 1969, at which time said hearing was con- cluded and closed; and M WHEREAS, the said public hearing afforded all in- terested parties the right to appear and be heard concerning the question of zoning, and the same satisfied all require- ments of law pertaining to such public hearing; and WHEREAS, subsequent to such public hearing, the Planning & Zoning Commission submitted its final report to the City Council, the said report having been accepted by the City Council as meeting the requirements of Article 1011f, V.A.T.S.; and WHEREAS, the City Council is now desirous of sub- mitting the question of the adoption of a zoning ordinance for the City of Baytown to the electors, under the power of referendum provided in Section 98 of the City Charter; NOW THEREFORE BAYTOWN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Section 1: That a special election shall be held in and throughout the City of Baytown, Texas, between the hours of 7:00 o'clock a.m. and 7:00 o'clock p.m. on the 20th day of May, 1969, at which election there shall be submitted to the resident qualified voters of said City of Baytown, for their action thereupon, the following proposition: "FOR adoption at this election, under the power of referendum provided in the City Charter, of the proposed comprehensive Zoning Ordinance for the City of Baytown." "AGAINST adoption at this election, under the power of referendum provided in the City Charter, of the proposed comprehensiVa Zoning Ordinance for the City of Baytown." Section 2: That the said City is hereby divided into election precincts and their polling places will be and election officials shall be, for the purpose of this -2- Ordinance, such ordinance shall thereupon be officially "WIN(W adopted and approved and shall become an ordinance of the City. Such ordinance, if adopted, shall be published, and may thereafter be amended or repealed by the City Council, as in the case of other ordinances. Section 7: Severdbi,lity Clause: If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or act of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circunstances and to this end they are declared to be severable. All duly qualified resident electors of the City of Baytown, Texas, shall be qualified to vote. Section 4: That the form of the ballow shall be substantially as follows: BALLOT "FOR adoption at this election, under the power of referendum provided in the City Charter, of the proposed comprehensive Zoning Ordinance for the City of Baytown." "AGAINST adoption at this election, under the power of referendum provided in the City Charter, of the proposed comprehensive Zoning Ordinance for the City of Baytown." Section 5: That the Chief of Police is hereby di- rected to post a properly executed copy of the election pro- clamation and notice at each polling place within the City not less than twenty (20) days prior to the date set herein for such election. The City Clerk is hereby directed to cause notice of said special election to be published in the official newspaper of the City of Baytown not less than ten (10) nor more than thirty (30) days before the said election.
