Ordinance No. 959ORDINANCE NO. 959 W AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN FORMALLY CALLING A JOINT PUBLIC HEARING BEFORE THE PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL PURSUANT TO ARTICLE 1011f, V.A.T.S., GIVING INTERESTED PARTIES AN OPPORTUNITY TO BE HEARD CONSIDERING THE QUESTION OF ZONING; ORDER- ING AND DIRECTING THE CITY CLERK TO PUBLISH A NOTICE OF THE SAID PUBLIC HEARING SO AS TO GIVE AT LEAST FIFTEEN (15) DAYS' NOTICE OF THE TIME AND PLACE OF SUCH PUBLIC HEARING; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Planning and Zoning Commission of the City of Baytown, together with the City Council, has reviewed the feasibility of zoning for the City of Baytown for more than two years; and WHEREAS, the Planning and Zoning Commission has proposed a draft zoning ordinance, and has met informally with the City Council on numerous occasions in connection therewith; and WHEREAS, the said Planning and Zoning Commission has made a Preliminary Report to the City Council, with the recommendation that the City Council adopt the proposed zon- ing ordinance; and WHEREAS, the City Council has given serious con- sideration to the adoption of such an ordinance, and desires to satisfy the conditions precedent to the adoption of such an ordinance, whether adopted by the City Council itself or submitted to a vote of the electors under Section 98 of the City Charter; and WHEREAS, Articles 1011d and 1011f, V.A.T.S., require the Planning Commission and City Council to hold public hearings, after published notices, giving interested parties an oppor- tunity to be heard considering the question of zoning; and WHEREAS, said Article 1011f, V.A.T.S., authorizes a City Council to pass an ordinance calling for a joint pu- blic hearing before the Planning and Zoning Commission and the City Council, to satisfy the legal requirements of a public hearing before: both of such bodies; NOW THEREFORE, Section 1: That a joint public hearing before the Planning and Zoning Commission and the City Council, pursuant to Article 1011f, V.A.T.S., for the purpose of giving interested parties the right to appear and be heard concerning the ques- tion of the adoption of a zoning ordinance for the City of Baytown, is hereby called for the loth day of March _)I 1969, at 7:00 o'clock p.m. in the Council Chambers of the City Hall. Section 2: That the City Clerk is hereby ordered and directed to publish a notice of the said public hearing in the official newspaper of the City of Baytown, so as to give at least fifteen (15) days' notice of the time and place of such public hearing. Section 3: That this ordinance shall take effect from and after the date of its passage by an affirmative vote of the City Council of the City of Baytown. of the City Council of the City of Baytown, on this the day of 1969.
