AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, REPEALING ALL ORDINANCES PASSED
PRIOR TO THE 26TH DAY OF OCTOBER, 1967, CONTAIN-
ING PROVISIONS CONTROLLING THE CONSTRUCTION, AL-
TERATION, EQUIPMENT AND REMOVAL OF BUILDINGS AND
STRUCTURES; PROVIDING A NEW BUILDING PERMIT FEE
SCHEDULE; CONTAINING A SAVINGS CLAUSE; AND PRO-
VIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown, for the purpose of
providing regulations controlling the construction, altera-
tion, equipment and removal of buildings and structures,
has from time to time passed certain ordinances pertaining
to the same; and
WHEREAS, by Ordinances Nos. 896 and 897, passed by
the City Council on the 26th day of October, 1967, the Southern
Standard Building Code, 1965 edition, and the Minimum Property
Standards for One and Two Living Units by the Federal Housing
Administration, were adopted, to be controlling in the con-
struction, alteration, equipment and removal of buildings and
structures for industrial and commercial construction and for
one and two units living quarters; and
WHEREAS, the said Southern Standard Building Code
and the Minimum Property Standards Code are now exclusively
controlling in their provisions concerning the construction
of the said buildings and structures, and fully supersede
all ordinances passed prior to October 26, 1967, pertaining
to the construction of the said buildings and structures; and
WHEREAS, the City desires to adopt a new building
permit fee schedule different and independent of those pro-
vided in prior ordinances as well as those provided in the
Southern Standard Building Code and the Minimum Property
Standards Code; NOW, THEREFORE,
BAYTOWN:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
Section 1: That all ordinances passed prior to
October 26, 1967 containing provisions controlling the
construction, alteration, equipment and removal of all build-
ings and structures, to include Ordinance No. 20, passed by
the City Council on the 9th day of September, 1948; Ordinance
No. 37, passed by the City Council on the 20th day of January,
1949; Ordinance No. 70, passed by the City Council on the
22nd day of December, 1949; Ordinance No. 98, passed by the
City Council on the 30th day of October, 1950; Ordinance No.
197, passed by the City Council on the 27th day of August,
1953; Ordinance No. 637, passed by the City Council on the
10th day of October, 1961; Ordinance No. 733, passed by the
City Council on the 12th day of October, 1964; Ordinance No.
844, passed by the City Council on the 13th day of October,
1966; and Ordinance No. 855, passed by the City Council on
the 9th day of February, 1967, were repealed by implication
upon the adoption of the Southern Standard Building Code and
the Minimum Property Standards Code, and the said ordinances
are hereby officially repealed by specific reference. All
other ordinances or parts of ordinances inconsistent with the
terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such incon-
sistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the
subject matter covered by this ordinance.
Section 2: Any person, firm or corporation applying
to the City of Baytown for a building permit, shall pay to the
City, prior to the issuance of said permit, a building permit
fee based on the following schedule:

Improvements costing:
a. $ 1.00 -to $ 499.00 ............ No charge
b - $500.00 to $1,000.00 ............ $5.00
C. Per each additional $1,000.00,
of improvements ................. $1.00
Section 3: Savings Clause: If any provision,
section, exception, subsection, paragraph, sentence, clause
or phrase of U-iis, ordinance or the application of same to any
person or set of circumstances, shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not
affect the validity of the remaining provisions of this or-
dinance or their application to other persons or sets of cir-
cumstances and to this end all provisions of this ordinance
are declared to be severable.
Section 4: Effective Date: This ordinance shall
take effect from and after its passage by the City Council
of the City of Baytown, Te.xas.
INTRODUCED, READ and PASSED by the affirmative vote
