AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION
OF PERMANENT PAVING AND OTHER IMPROVEMENTS WITHIN THE
FOLLOWING DEFINED PORTIONS OF WARD ROAD IN THE CITY OF
BAYTOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND
ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN &
ROOT, INC., THE CONTRACTOR PERFORMING SAID WORK; APPROV-
ING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICATES.;
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY, COUNCIL OF THE CITY OF BAYTOWN,
TEXAS;
Section 1: That the work of improving Ward Road between
North Main Street and State Highway No. 146,
within the City of Baytown, Texas, by raising, grading, filling,
widening, permanently paving and repaving same, and by the construction,
reconstruction, repairing and realigning of concrete curbs and gutters,
and by the construction of such drains and other necessary incidentals
and appurtenances as deemed necessary by the City Engineer, said
permanent paving consisting of reinforced concrete pavement upon
a properly prepared subgrade, of such type, construction, materials
and thickness as deemed adequate and suitable by the City Engineer,
and all of said improvements being as provided fcr in the Plans
and Specifications therefor-which have heretofore been prepared by
the City Engineer and as have been approved and adopted by the City
Council; and all of same having been performed and completed in full
accordance .nth all the terms andprovisions of the contract dated
Dec. 28, 1967, between said City of Baytown, Texas, and Brown &
Root, Inc., and said City Engineer having measured, examined and
caused to be treated the finished improvements by the means and in
the manner provided by the terms of said contract and the Plans and
Specifications, and said City Engineer having approved and accepted
said work and improvements and having heretofore issued his Certificate-.
of Final Acceptance, and so certified to said City Council and re-
commended that it accept and receive said work and the improvements
as constructed and completed by said Brown and Root, Inc., and
said work and imp 'rovements having been examined and found by the
Mayor and City Council of the said City of Baytown, Texas, to have
beenperformed and completed in full compliance with said contract
and said Plans and Specifications therefor, and same are hereby
accepted and received by said City Council of the City of Baytown,
section 2: That the Mayor and City Clerk of the City of
Baytown, Texas, are hereby authorized and directed to execute and issue
to Brown & Root, Inc., Special Assessment Certificates evidencing the
assessments levied against the properties improved abutting upon said
portions of ward Road and against the real and true owners thereof,
which, by the terms of said contract, the City of Baytown, Texas, has
agreed and obligated itself to issue and deliver to said Brown & Root,
Ind., in accordance with provisions'of the reiative'proceedings here-
tofore had and adopted by said City Council; said Special Assessment
Certificates to be executed in the name of said City by its Mayor
and City Clerk, and impressed with the seal of said City, and dated as
of the date hereof, and such officers are hereby authorized and directed
to execute said certificates in their official capacities on behalf of
said City, and deliver same to said Brown & Root, Ina., said Special
Assessment Certificate having heretofore been prepared and printed,
a copy of which is on file with the City Clerk, the form and contents
thereof being hereby approved and adopted.
Section 3: This ordinance shall take effect from and after
the date of its passage by a majority of the City Council of the City
of Baytown.
