Ordinance No. 936ORDINANCE NO. 936 AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, TO BE KNOWN AS THE "TRAFFIC "CODE OF THE CITY OF BAYTOWN; REGULATING TRAFFIC ON THE PUBLIC STREETS OF THE CITY OF BAYTOWN; WORDS AND PHRASES DEFINED; AUTHORITY OF POLICE; DRIVING REGULATIONS -RULES OF THE ROAD; TURNING AND STARTING AND SIGNALS ON STOP- PING AND TURNING; ACCIDENTS, RECKLESS DRIVING, START- ING PARKED VEHICLES; TRAFFIC AND PEDESTRIAN SIGNALS; PEDESTRIANS' RIGHTS AND DUTIES; PARKING REGULATIONS; SPECIAL STOPS REQUIRED; MISCELLANEOUS DRIVING RULES; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAIN- ING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF ", BEING ORDI- NANCE NO. 752, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 26TH DAY OF AUGUST, 1965, BY AMEND- ING ARTICLE III - DRIVING REGULATIONS - SPEED, SEC- TION 22; REPEALING ORDINANCE NO. 849, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 12TH DAY OF JANUARY, 1967, AND ORDINANCE NO. 856, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 9TH DAY OF FEBRUARY, 1967; AND PROVIDING FOR THE PUBLI- CATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Article III - Driving Regulations - Speed, Section 22, shall be amended to read as follows, to -wit: Section 22: Upon the basis of an engineering and traffic investigation heretofore made, as authorized by the provisions of Section 8 of Article 827a, Vernon's Texas Penal Code, the maximum speed limits for all motor vehicles (except emergency vehicles) shall be 30 miles per hour except as follows: (a) 35 Miles Per Hour Speed_Zones 1. West Texas Avenue: From Goose Creek Stream to Airhart Drive. 2. Highway No. 146: From Holiday Inn to Davis Road. 3. Park Street: From Bayway Drive to Airhart Drive. 4. Lee Drive: From Gentry Street to West Main Street. 5. Missouri Street: From Spur 201 to New Jersey Street. 6. Decker Drive: From Garth Road to Airhart Drive. (b) 40 Miles Per Hour Speed Zones 1. South Alexander Drive: From the intersection of South Main Street to the intersection of Highway no. 2. West Main Street: From Spur 201 to Caroline Street. 3. Market Street: From 300 feet West of Traffic Circle to three- tenths (3/10) of a mile from the intersection of West Main Street with the exception of Robert E. Lee School Zone during posted hours. 4. Airhart Drive: From Park Street to Lynchburg Road. 5. East James Street: From Bayou Drive - West to 10th Street. 6. Park Street: From Garth Road - West to intersection of Decker Drive. 146 . 7. Highway No. 146: From Davis Road to Cedar Bayou Road. 8. Baaay Drive: From Baytown Elementary School to Decker Drive. 9. Massey Tompkins Road: From North Main to McKinney. 10. Bob Smith Road: From North Main to McKinney. 11. Garth Road: From Scenic Drive to North City limits Baker Road) . 12. Cedar Bayou Road: From North Main Street to Highway No. 146. 13. Cedar Bayou- CrosbX Road: From Highway No. 146 to North City limits. 14. Garth Road: From the South right -of -way line of Park Street to the East property line of Decker Drive. 15. West Main Street: From Yupon Street to Spur 203 Douglas Drive). (c) 45 Miles Per Hour S eed Zones 1. Decker Drive: From Airhart Drive to three - tenths (3/10) of a mile East of San Jacinto Street. 2. Baker Road: From St. James House to Garth Road. 3. North Main Street: From Bob Smith Road to North City limits. (d) 50 Miles Per Hour Speed Zones 1. Hi hwa No. 146: From Cedar Bayou Road to North City limits- (Cedar Bayou Bridge). 2. Highway No. 146: From Alexander Drive to begin- ning of traffic exchange at Lee Drive. 3. Highway No. 146: From traffic exchange at Lee Drive to City limits. 4. Tri -City Beach_ Road: From Normandy House Apart- ments to City limits. 5. Loop 201: From West Main Street to Highway No. 146. (e) 55 Miles Per Hour Speed Zones 1. Decker Drive: From three -- tenths (3/10) of a mile of San Jacinto Street to City limits. A twenty (20)miles per hour speed limit is es- tablished on all streets adjacent to public schools unless other- wise designated. Section 2: That Ordinance No. 849, passed by the City Council of the City of Baytown on the 12th day of January, 1967, and Ordinance No. 846, passed by the City Council of the City of Baytown on the 9th day of February, 1967 are hereby repealed and shall cease to have force and effect from and after the effective date of this ordinance. Except as herein amended, all of the terms and provisions of said Ordinance No. 752, as amended by Ordinance No. 929, are hereby continued in full force and effect and any -2- person violating any of the terms of said Ordinance No. 752 shall be subject to the penalties provided therein. Section 3: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at Least twice prior to the effective date thereof.
