Ordinance No. 924ORDINANCE NO. 924 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE THE SUM OF FORTY SIX THOUSAND ONE HUNDRED SEVENTY FIVE AND N01100 ($46,175.00) DOLLARS FROM THE UNAPPROPRIATED CON- TINGENCIES FUND CREATED BY ORDINANCE NO. 415, PAS- SED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON MAY 13, 1957, TO WATER AND SEWER FUND ACCOUNT NO. 1002 -9 -4 (CAPITAL IMPROVEMENT SANITARY SEWERS). WHEREAS, the City of Baytown operates a Waterworks and Sanitary Sewer System, and is responsible for the main- tenance of such system as well as the implementation of all necessary extensions, alterations, replacements and improve- ments; and WHEREAS, the City of Baytown has been required, because of road construction, to make certain alterations in certain sewer and water lines adjacent to Spur 201, within the corporate limits of the said City; and WHEREAS, sufficient monies are not available through normal funding to meet the expense of altering the said sewer and water lines; and WHEREAS, the City of Baytown has previously esta- blished a Contingencies Fund under Ordinance No. 415, passed by the affirmative vote of the City Council on May 13, 1957; said Contingencies Fund being in the amount of Fifty Thousand ($50,000.00) Dollars, and said Ordinance No. 415 providing that said Contingencies Fund may be issued to pay unusual maintenance and operation expenses incident to the operation of the said Waterworks and Sanitary Sewer System; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The City Council of the City of Baytown finds that the alteration of sewer and water lines in the vicinity of Spur 201 is essential; that funds are not other- wise available to meet the cost of such alterations; and that a condition exists which merits a disbursement from the r , Contingencies Fund created by Section 9.02c of the said Ordinance No. 415. Section 2: That the City Manager of the City of Baytown is hereby authorized to appropriate the sum of Forty Six Thousand One Hundred Seventy Five ($46,175.00) Dollars from the aforementioned Contingencies Fund to Water and Sewer Fund Account No. 1002 -9 -4 (Capital Improvement Sanitary Sewers), to pay the necessary expenses of the aforementioned sewer and water line alterations.
