AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN PROVIDING FOR
THE LICENSING OF NIGHT WATCHMEN; REGULATING AND PROVIDING CERTAIN
STANDARDS FOR THE OPERATION OF SAME; REPEALING ORDINANCES INCONSISTENT
HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING A PENALTY AND THE
EFFECTIVE DATE HEREOF,
WHEREAS, various individuals have operated night watchmen services in
the City of Baytown for a number of years; and
WHEREAS, such services have never been regulated by such City and the
City Council believes that same should be regulated; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That henceforth no person shall operate a night watchmen
service without first having applied for and having received a license or permit
from the City of Baytown. Any person desiring to engage in such business shall
make application to the City Manager on a form prescribed by the City Clerk. Each
applicant and any and all of his employees shall be finger - printed and photographed
by the Baytown Police Department. Permits shall not be issued to anyone convicted
of a felony or an offense involving moral turpitude. All agents and employees of
permittee shall likewise be finger- printed and photographed by the Baytown Police
Department and they shall be prohibited from working in such capacity if they have
been convicted of a felony or an offense involving moral turpitude. Such permits,
when issued, shall be issued on a calendar year basis so that same shall expire at
midnight, December 31 of each year. The fee for such permit shall be $25.00 per
year. Such permits shall be cancelled if the permittee violates any of theterms
of this ordinance.
Section 2: That each permittee shall have liability insurance of a nature
and in an amount approved by the City Attorney and the City Council.
Section 3: Each permittee shall have the company name of such night watch-
man service printed on each side of any and all vehicles used by it in letters b"
in height and approved by the Chief of Police. No vehicles used in such night watch-
man service shall be equipped with emergency lights or sirens.
Section 4: That any and all officers, agents and employees of such
permittee, while on duty, shall wear uniforms approved by the City Manager and Chief
of Police but they will in no way resemble the uniform of the Baytown Police
Department.

Section 5: That such permittee shall inform the Chief of Police by map
or in a manner approved by said Chief of Police as to the territory within the
City that such permittee shall be patrolling.
Section 6: That any officer, agent or employee of such permittee or the
permittee himself, if he is so involved, shall have his right to act as a night
watchman terminated if he commits any of the following:
1. Fails to make a report to the Police Department of any crime, fire,
or open building if the building is under his surveillance, and;
2. Any conviction of a felony or an offense involving moral turpitude.
Section 7: If any provision, exception, section, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or act of circumstances, shall for any reason be held unconstitutional, void
or invalid, such invalidity shall not affect the validity of the remaining provisions
of this ordinance or their application to other persons or sets of circumstances and
to this end all provisions of this ordinance are declared to be severable.
Section 8: All ordinances or parts of ordinances inconsistent with the
terms of this ordinance are hereby repealed; provided, however, that such repeal
shall be only to the extent of such inconsistency, and in all otherrespects this
ordinance shall be cumulative of other ordinances regulating and governing the sub-
ject matter covered by this ordinance.
Section 9: Any person who shall violate any provision or provisions of
this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be
punished by a fine of not more than One Hundred ($100.00) Dollars. Each day of the
continuance of such violation shall be considered a separate offense.
Section 10: This ordinance shall take effect from and after ten. (10) days
after its passage by the City Council. The City Clerk is hereby directed to give
notice hereof by causing the caption of this ordinance to be published in the
official newspaper of the City of Baytown at least twice within ten (10) days after
its passage.
