Ordinance No. 903ORDINANCE NO. 903 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AMENDING PARA- GRAPH (n), SECTION 5, OF ORDINANCE NO. 643, REPEALING ORDINANCES IN CONFLICT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICA- TION AND EFFECTIVE DATE HEREOF. Section 1: That Paragraph (n), Section 5, of Ordinance No. 643 shall be amended and, as amended, shall read as follows: (n) Sanitary sewer service is becoming available to relatively large sections of Baytown and the City Council wants to give the affected citizens proper and fair notice of such fact and, to this end, the following procedure shall be employed: When it is determined that the owners of real property are within a distance of three hundred feet (300') of any public drain, sanitary main or sanitary lateral sewer, the City's Health Department shall notify such property owners of such fact and tell such owners that they have ninety (90) days in which to connect with said sanitary sewer and to remove any and all privies and cess pools. At the end of such ninety (90) days period of time, each such owner that has not complied with such request and notice shall be sent a mandatory thirty (30) days notice by the Health Department to the same effect except the owner shall have only thirty (30) days in which to connect with said sanitary sewer and remove any privies or cess pools. Failure to comply with such latter thirty (30) days notice shall be a violation of the terms and provisions of this ordinance and each day such failure shall continue shall constitute a separate offense. Section 2: Repealing Clause: All ordinances or parts of ordinances in conflict with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any section or provisions, or parts thereof in this ordinance shall be adjudged invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity of the ordinance as a whole or any other section or provision or part hereof. Section 4: Penalty Clause: Any person, firm or corporation violating any provisions of this ordinance or failing to observe any provisions hereof shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum of not more than Two Hundred ($200.00) Dollars. Section 5: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
