AN ORDINANCE PROHIBITING ANYONE EXCEPT EMPLOYEES
OF THE CITY OF BAYTOWN FROM EMPTYING GARBAGE CANS
OR TRASH RECEPTACLES INTO OR TRANSPORTING GARBAGE
OR TRASH TO ANY DUMP OR DUMPS OV.rNED OR MAINTAINED
BY THE CITY WITHOUT PAYING FOR SUCH PRIVILEGE; FIXING
SCHEDULES OF REASONABLE CHARGES TO BE MADE AGAINST
PRIVATE HAULERS; PROVIDIN 3 THAT THIS ORDINANCE SHALL
NOT APPLY TO PERSONS RESIDING WITHIN BAYTOWN AND
DUMPING FROM PASSENGER VEHICLES; PROVIDING A SAVINGS
CLAUSE; REPEALING ORDINANCES IN CONFLICT HEREWITH;
FIXING A PENALTY FOR THE VIOLATION THEREOF AND PRO-
VIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: No person except duly authorized agents, employees and
officers of the City of Baytown and operators of Class A vehicles as described
in Sections Z and 3 of this ordinance, shall empty garbage or trash into any dump
or dumps owned or maintained by the City unless such person presents to the
dump attendant a valid ticket authorizing the dumping of garbage or trash. It
shall be unlawful for any attendant at a dump or dumps owned or maintained by
the City, or any other employee of the City, to allow or permit any person to
dump garbage or trash in a City dump unless a ticket for such dumping has been
presented to such attendant or employee. Tickets collected shall be transmitted
to the Director of Finance daily.
Section 2: The Director of Finance shall furnish the said attendants at
such dump ground with tickets as hereinafter provided. Such tickets shall cover
vehicles of less than one ton capacity and vehicles in excess of one ton capacity
and such two divisions shall have classes as set forth:
VEHICLES: ONE TON OR LESS
(1) Class A: Vehicles hauling garbage from within the limits
of Baytown. (Nan - commercial, non - business)
(Z) Class B: Vehicles hauling garbage from outside the limits
of Baytown.
(3) Class C: Vehicles hauling garbage from within the limits
of Baytown. (Commercial or business)
VEHICLES: EXCESS OF ONE TON
(1) Class D: Vehicles hauling garbage from within the limits
of Baytown.
(Z) Class E: Vehicles hauling garbage from outside the limits
of Baytown.
Section 3: The Director of Finance shall prepare ticket books, numbered
consecutively, for each class. Each ticket book shall contain tickets authorizing
the dumping of one load of trash or garbage at the city dump and books containing

twenty -five (25) tickets, fifty (50) tickets and one hundred (100) tickets shall be
prepared and the fees shall be as follows:
(1) Class A: Passenger vehicles, including one - seated, two -
seated, coaches, sedans and coups - - - -No Charge
Non - commercial, non- business pick -ups and
trailers ---------------------------------- .. ---No Charge
(2) Class B: ------------ ---------- -- ------ - - - - -- $2.00 per ticket.
(3) Class C: -------------------- ---- ------ - - - - -- . 25 per ticket.
(4) Class D: --------------------- --------- - - - - -- .50 per ticket.
(5) Class E: - ----------- - - ---- ------- -- - ---- 5.00 per ticket.
Any person desiring to dump garbage and refuse at such city owned or
city maintained dumping grounds may do so by purchasing one or more tickets
appropriate for such privilege under a receipting procedure established by the
Director of Finance.
Section 4: All ordinances or parts of ordinances inconsistent with the
terms of this ordinance are hereby repealed; provided, however, that such re-
peal shall be only to the extent of such inconsistency and in all other respects
this ordinance shall be cumulative of other ordinances regulating and governing
the subject matter covered by this ordinance.
Section 5: if any provision, exception, section, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not effect the validity of the remaining
provisions of this ordinance and, to this end, all provisions of this ordinance
are declared to be severable.
Section b: Any corporation, firm, agent or person violating any section
or sections of this ordinance shall be deemed guilty of a misdemeanor and sub-
ject to a fine in any sum not to exceed Two Hundred ($200.00) Dollars. Each
day, or any fraction thereof, which this ordinance or any part thereof shall be
violated shall be deemed a separate offense and punishable as such.
Section 7: This ordinance shall take effect from and after thirty (30)
days after its passage by the City Council. The City Clerk is hereby directed
to give notice hereof by causing the caption of this ordinance to be published in
the official newspaper of the City of Baytown at least twice prior to the effect-
ive date thereof.

Section 5: Should any portion of the area herein designated as an
Industrial District be not actually situated within the extraterritorial juris-
diction of the City of Baytown, Texas, and not therefore capable of being so
designated, such fact shall not affect the validity of this designation as to the
remaining portions of said area.
Section 6: Repealing Clause. All ordinances or parts of ordinances in-
consistent with the terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency, and in all
other respects this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 7: Savings Clause. If any provision, exception, section, sub-
section, paragraph, sentence, clause or phrase of this ordinance or the application
of same to any person or set of circumstances shall for any reason be held uncon-
stitutional, void or invalid, such invalidity shall not affect the validity of the
remaining provisions of this ordinance or their application to other persons or sets
of circumstances and to this end, all provisions of this ordinance are declared to be
severable.
Section 8: Effective Date. This ordinance shall take effect from and after
ten (10) days from its passage by the City Council. The City Clerk is hereby
directed to give notice hereof by causing the caption of this ordinance to be
published in the official newspaper of the City of Baytown at least twice within
ten (10) days after the passage of this ordinance.
